REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 6486 - Ա, June 30, 2009 ON RESTORING THE PROPERTY RIGHTS OF EDUARD GAREGINI ABAJYAN, GAREGIN SURENI ABAJYAN, HASMIK KEROBI HARUTYUNYAN, GAYANE SURENI ABAJYAN, KARINE SURENI ABAJYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT NOR ARESH 4TH STREET, H. 2/1 ADDRESS

The application of Eduard Garegini Abajyan (born 21.02.1941), Garegin Sureni Abajyan (born 27.02.1963), Hasmik Kerobi Harutyunyan (born 00.00.1937), Gayane Sureni Abajyan (born 11.03.1961), Karine Sureni Abajyan (born 31.08.1972) served as the basis for the discussion of the issue. It was revealed from the clarification of the topographic survey that the total area of the land plot at Nor Aresh 4th Street, h.2/1 address actually constitutes 1028.78 sq.m., of which the land plot with an area of 796 sq.m. belongs to Eduard Garegini Abajyan, Garegin Sureni Abajyan, Hasmik Kerobi Harutyunyan, Gayane Sureni Abajyan, Karine Sureni Abajyan by right of ownership (from the land plot with an area of 800 sq.m., the land plot with an area of 796 sq.m. is used). The land plot with an area of 232.78 sq.m. used adjacent to the legal land plot can be transferred by right of gratuitous ownership by force of law. Taking into account that the residential house was built before 1989, the letters of the Erebuni territorial subdivision of the State Committee of the Cadastre of Real Estate adjunct to the Government of the Republic of Armenia dated 14.10.2008, h.3-6233, the "Land and Property Operations" CJSC of the Yerevan City Hall dated 23.06.2009, h.20/2-Ե-452, the conclusion of the Department of Architecture and Urban Development of the Staff of the Yerevan City Hall dated 18.06.2009, h.20-Ել-7436, according to which the land plot occupied by the residential house at Nor Aresh 4th Street, h.2/1 and necessary for its maintenance complies with the requirements defined by sub-points 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided by Article 60 of the same code, guided by the Law of the Republic of Armenia "On the Status of Individual Residential Houses in the City of Yerevan for which Title Documents are not Preserved", the Decision of the Government of the Republic of Armenia dated December 29, 2005 "On Approving the Procedure for Naming, Renaming Intra-settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, Numbering, Addressing and State Registration of Addresses of Real Estate According to its Location and/or Placement, and Designating the Authorized Body for Address Registration" h.2387-Ն.

  1. Restore the right of land use of Eduard Garegini Abajyan, Garegin Sureni Abajyan, Hasmik Kerobi Harutyunyan, Gayane Sureni Abajyan, Karine Sureni Abajyan to the property units located at Nor Aresh 4th Street, h.2/1 address, to the extent of the land plot with an area of 232.78 sq.m. adjacent to the legal land plot with an area of 796 sq.m. occupied by the residential house and necessary for its maintenance, recognizing their right of ownership to the land plot with an area of 232.78 sq.m. and the buildings located thereon.
  2. The areas of the buildings are subject to clarification by the Erebuni territorial subdivision of the State Committee of the Cadastre of Real Estate adjunct to the Government of the Republic of Armenia.

  6. Instruct the Head of the Secretariat of the Staff of the Yerevan City Hall to deliver copies of this decision to the Head of the Erebuni administrative district within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be placed on the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan City Hall.
  8. Control over the implementation of the decision shall be placed on A. Sargsyan, Assistant to the Mayor of Yerevan.
