This decision restores the property rights of Ruben Samsoni Mkrtchyan, Karen Samsoni Mkrtchyan, Hrahat Samsoni Mkrtchyan, Anahit Samsoni Mkrtchyan and Gayane Babkeni Serobyan to the land plot of 184.15 sq.m. adjacent to the residential house located at Charents Street, No. 71/21, and the buildings and structures located thereon. REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 6492 - A, June 30, 2009

ON RESTORING THE PROPERTY RIGHTS OF RUBEN SAMSONI MKRTCHYAN, KAREN SAMSONI MKRTCHYAN, HRAHAT SAMSONI MKRTCHYAN, ANAHIT SAMSONI MKRTCHYAN, GAYANE BABKENI SEROBYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT CHARENTS STREET, H. 71/21

The application of Ruben Samsoni Mkrtchyan (born 23.12.1953), Karen Samsoni Mkrtchyan (born 16.04.1955), Hrahat Samsoni Mkrtchyan (born 01.12.1956), Anahit Samsoni Mkrtchyan (born 28.12.1958), Gayane Babkeni Serobyan (born 17.08.1951) served as the basis for discussing the issue. It was clarified from the topographic survey that the total area of the land plot at Charents Street, h.71/21, actually amounts to 603.45 sq.m, of which the land plot with an area of 419.3 sq.m belongs to Ruben Samsoni Mkrtchyan, Karen Samsoni Mkrtchyan, Hrahat Samsoni Mkrtchyan, Anahit Samsoni Mkrtchyan, Gayane Babkeni Serobyan by right of ownership. The land plot with an area of 184.15 sq.m, used adjacent to the legal land plot, can be transferred by right of gratuitous ownership by force of law. Taking into account that the residential house was built before 1969, the inheritance certificates of 20.02.2007, the letter of "Land and Property Operations" CJSC of Yerevan City Hall dated 27.04.2009, h.20/2-E/281, the conclusion of the Architecture and Urban Development Department of the Yerevan City Hall staff dated 21.04.2009, h.20-El-3753, according to which the land plot occupied by the residential house at Charents Street, h.71/21, and necessary for its maintenance, complies with the requirements defined by sub-points 1, 2, 3 of point 2 of Article 64 of the RA Land Code and is not included in the list of restrictions provided for by Article 60 of the same code, guided by the RA law "On the status of individual residential houses in Yerevan city for which title documents have not been preserved", the RA Government Decision N 2387-N of December 29, 2005 "On approving the procedure for naming, renaming intra-settlement geographical objects in urban and rural settlements of the Republic of Armenia, numbering, addressing and state registration of addresses of real estate according to its location and/or placement, and defining the authorized body for address registration".

  1. Restore the land use right of Ruben Samsoni Mkrtchyan, Karen Samsoni Mkrtchyan, Hrahat Samsoni Mkrtchyan, Anahit Samsoni Mkrtchyan, Gayane Babkeni Serobyan to the property units located at Charents Street, h.71/21, to the extent of the land plot with an area of 184.15 sq.m adjacent to the legal land plot with an area of 419.3 sq.m occupied by the residential house and necessary for its maintenance, recognizing their right of ownership to the land plot with an area of 184.15 sq.m and the buildings located thereon.
  2. The areas of the buildings are subject to clarification by the Marash territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the unified master plan issued by the Architecture and Urban Development Department of the Yerevan City Hall staff.
  4. Grant an address to the residential house at Charents Street, h.71/7: "Charents Street, h.71/21 house".
  5. Propose to the Marash territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the right of ownership of citizens Ruben Samsoni Mkrtchyan, Karen Samsoni Mkrtchyan, Hrahat Samsoni Mkrtchyan, Anahit Samsoni Mkrtchyan, Gayane Babkeni Serobyan to the land plot mentioned in point 1 of this decision, to provide a certificate of registration of real estate ownership, resolving the issues of real estate accounted for as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan City Hall staff to deliver copies of this decision to the Head of Kentron administrative district within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall staff.
  8. Control over the implementation of the decision shall be assigned to A. Sargsyan, Assistant to the Mayor of Yerevan.
