This decision restores the right of land use of Yurik Avetisi Avetisyan, Gevorg Avetisi Avetisyan and Ashot Vladimiri Avetisyan to the land plot with an area of 43.84 sq.m. located at 44/1 Droi Street and recognizes their right of ownership to the mentioned land plot and the buildings located on it. The decision also instructs the Zeytun territorial division of the State Committee of Cadastre to register the right of ownership and provide a registration certificate.

DECISION N 5815 - A OF THE MAYOR OF YEREVAN

June 03, 2009

ON RESTORING THE PROPERTY RIGHTS OF YURIK AVETISI AVETISYAN, GEVORG AVETISI AVETISYAN, ASHOT VLADIMIRI AVETISYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT DRO STREET, H. 44/1

The application of Yurik Avetisi Avetisyan (born 17.05.1932), Gevorg Avetisi Avetisyan (born 06.10.1967), Ashot Vladimiri Avetisyan (born 03.10.1973) served as the basis for the discussion of the issue. From the clarification of the topographic survey, it was found that the total area of the land plot at Dro Street, h. 44/1 is actually 497 sq.m., of which the land plot with an area of 448 sq.m. is the property of Yurik Avetisi Avetisyan, Gevorg Avetisi Avetisyan, Ashot Vladimiri Avetisyan. The land plot with an area of 43.84 sq.m. used adjacent to the legal land plot can be transferred free of charge by virtue of law, and the land plot with an area of 5.16 sq.m. cannot be provided, as it is located outside the construction line.

Taking into account that the residential house was built before 1990, the certificates of inheritance rights dated 27.12.2008, the letter h. 159 dated 06.02.2009 of the Zeytun territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia, the conclusion h. 20-El-6654 dated 29.05.2009 of the Department of Architecture and Urban Development of the Yerevan City Hall staff, according to which the land plot occupied by the residential house at Dro Street, h. 44/1 and necessary for its maintenance complies with the requirements set forth in sub-points 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for in Article 60 of the same Code, guided by the Law of the Republic of Armenia "On the status of individual residential houses in Yerevan city for which title documents have not been preserved", by the decision h. 2387-N of the Government of the Republic of Armenia dated December 29, 2005 "On approving the procedure for naming, renaming intra-settlement geographical objects in urban and rural settlements of the Republic of Armenia, numbering, addressing and state registration of addresses of real estate according to its location and /or/ placement, and on establishing the authorized body for address registration".

  1. Restore the right of land use of Yurik Avetisi Avetisyan, Gevorg Avetisi Avetisyan, Ashot Vladimiri Avetisyan to the property units located at Dro Street, h. 44/1, to the extent of the land plot with an area of 43.84 sq.m. adjacent to the legal land plot with an area of 448 sq.m. occupied by the residential house and necessary for its maintenance, recognizing their right of ownership to the land plot with an area of 43.84 sq.m. and the buildings located thereon.
  2. The areas of the buildings are subject to clarification by the Zeytun territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the unified master plan provided by the Department of Architecture and Urban Development of the Yerevan City Hall staff.
  4. Assign the address "Dro Street, h. 44/1 house" to the residential house at Dro Street, h. 44.
  5. Suggest to the Zeytun territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the right of ownership of citizens Yurik Avetisi Avetisyan, Gevorg Avetisi Avetisyan, Ashot Vladimiri Avetisyan to the land plot mentioned in point 1 of this decision, to provide a certificate of registration of real estate ownership, resolving the issues of real estate accounted for as a result of inventory.
  6. Instruct the head of the secretariat of the Yerevan City Hall staff to send copies of this decision to the Kanaker-Zeytun district administration within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be placed on the head of the Department of Architecture and Urban Development of the Yerevan City Hall staff.
  8. The control over the implementation of the decision shall be placed on A. Sargsyan, head of the Legal Department of the Yerevan City Hall staff.
