Regarding the restoration of property rights of Arsen Sergeyevich Ghazaryan over the residential house at Forest Street, No. 122/1

ON RESTORING THE PROPERTY RIGHTS OF ARSEN SERGEY GHAZARYAN TO THE RESIDENTIAL HOUSE AT ANTARAIN STREET, H.122/1

The application of Arsen Sergey Ghazaryan (born 23.05.1970) served as the basis for discussing the issue. According to the citizen's statement, there is no registered right to the property unit at Antarain Street, h.122/1. Taking into account that the residential house was built before 1950, the conclusion no. 20-Yel-7638 of 23.06.2009 of the Department of Architecture and Urban Development of the Yerevan Municipality Staff, according to which the land plot occupied by the residential house at Antarain Street, h.122/1, and necessary for its maintenance, complies with the requirements defined by subparagraphs 1, 2, 3 of paragraph 2 of Article 64 of the RA Land Code and is not included in the list of restrictions provided for by Article 60 of the same Code.

Guided by the RA Law "On the Status of Individual Residential Houses in Yerevan City for which Title Documents have not been Preserved", and the RA Government Decision No. 2387-N of December 29, 2005, "On Approving the Procedure for Naming, Renaming Intra-Settlement Geographical Objects, Numbering, Addressing, and State Registration of Addresses of Immovable Property by its Location and/or Placement in Urban and Rural Settlements of the Republic of Armenia and Defining the Authorized Body for Address Registration":

  1. Restore Arsen Sergey Ghazaryan's right to land use for the property units located at Antarain Street, h.122/1, for the land plot of 265.83 sq.m. occupied by the residential house and necessary for its maintenance, recognizing his right of ownership over the land plot of 265.83 sq.m. and the buildings and structures located on it.
  2. The areas of the buildings and structures are subject to clarification by the Kentron Territorial Division of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the general plan issued by the Department of Architecture and Urban Development of the Yerevan Municipality Staff.
  4. Assign the address "Antarain Street, h.122/1 house" to the residential house at Antarain Street, h.122/1.
  5. Suggest to the Kentron Territorial Division of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the ownership right of citizen Arsen Sergey Ghazaryan over the fixed land plot and building-structure, to provide a certificate of state registration of ownership right for immovable property, resolving the issues of immovable property registered as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan Municipality Staff to deliver copies of this decision to the Head of Kentron Administrative District within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Yerevan Municipality Staff.
  8. Control over the implementation of the decision shall be assigned to Assistant to the Mayor of Yerevan A. Sargsyan.
