ON REINSTATEMENT OF PROPERTY RIGHTS OF MISAK HOVHANNESI IRITSYAN OVER THE LAND PLOT ADJACENT TO THE RESIDENTIAL HOUSE AT THE ADDRESS: 1ST LANE OF JIVANI STREET, HOUSE 1, AND OVER THE BUILDINGS AND STRUCTURES

The basis for the discussion of the issue was the application of Misak Hovhannesi Iritsyan (born 26.06.1949).

The clarification of the topographic survey revealed that the total area of the land plot at the address: 1st Lane of Jivani Street, House 1, is actually 374.2 sq.m., of which the land plot with an area of 157 sq.m. belongs to Misak Hovhannesi Iritsyan by right of ownership. The land plot with an area of 217.2 sq.m., used adjacent to the legal land plot, can be transferred by right of ownership free of charge by force of law.

Considering that the residential house was built before 1997, based on the verdict of the Malatia-Sebastia community court of first instance of Yerevan dated 27.06.2006 in civil case No. 2-2953, letters No. 407 dated 24.12.2008 of the Shengavit territorial division of the State Committee of Real Estate Cadastre Adjunct to the Government of the Republic of Armenia, No. 20/2-E/417 dated 29.05.2009 of the "Land and Property Operations" CCPE of the Yerevan Municipality, the conclusion No. 20-El-6390 dated 25.05.2009 of the Architecture and Urban Development Department of the Staff of the Yerevan Municipality, according to which the land plot occupied by the residential house at 1st Lane of Jivani Street, House 1, and necessary for its maintenance, meets the requirements defined by subparagraphs 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same code, guided by the Law of the Republic of Armenia "On the Status of Individual Residential Houses in Yerevan City for Which Documentation Confirming Rights is Not Preserved," by the Decision No. 2387-N of the Government of the Republic of Armenia dated December 29, 2005 "On Approving the Procedure for Naming, Renaming Geographical Objects within Urban and Rural Settlements of the Republic of Armenia, Numbering Real Estate by Place of Location and/or Placement, and State Registration of Addresses, and on Defining the Authorized Body for Address Registration":

  1. Reinstate the land use right of Misak Hovhannesi Iritsyan over the property units located at the address: 1st Lane of Jivani Street, House 1, in the amount of a land plot of 217.2 sq.m. adjacent to the legal land plot of 157 sq.m. necessary for the residential house and its maintenance, recognizing his right of ownership over the land plot of 217.2 sq.m. and the buildings and structures located thereon.
  2. The areas of the buildings and structures are subject to clarification by the Shengavit territorial division of the State Committee of Real Estate Cadastre Adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the unified master plan issued by the Architecture and Urban Development Department of the Staff of the Yerevan Municipality.
  4. Grant the residential house at the address: 1st Lane of Jivani Street, House 1, the address: "House 1, 1st Lane of Jivani Street".
  5. Propose to the Shengavit territorial division of the State Committee of Real Estate Cadastre Adjunct to the Government of the Republic of Armenia to register the right of ownership of citizen Misak Hovhannesi Iritsyan over the land plot specified in point 1 of this decision, to issue a certificate of registration of the right of ownership of real estate, resolving the issues of real estate registered as a result of inventory.
  6. Assign the Head of the Secretariat of the Staff of the Yerevan Municipality to send copies of this decision to the Malatia-Sebastia district administration within a 5-day period.
  7. Assign the organization of the execution of this decision and the responsibility to the Head of the Architecture and Urban Development Department of the Staff of the Yerevan Municipality.
  8. Delegate the control over the execution of the decision to the Head of the Legal Department of the Staff of the Yerevan Municipality, A. Sargsyan.
