REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 5816 - A, June 03, 2009 ON RESTORING THE PROPERTY RIGHTS OF KHACHATUR LEVIKI AMALYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT 119 A. KHACHATRYAN STREET

The application of Khachatur Leviki Amalyan (born 07.05.1958) served as the basis for discussing the issue. It was found from the clarification of the topographic survey that the total area of the land plot at 119 A. Khachatryan Street is actually 895.28 sq.m., of which the land plot with an area of 600 sq.m. belongs to Khachatur Leviki Amalyan by right of ownership (certificates issued on 23.10.1992 N 5567 and 05.04.1999 N 0129281). The land plot with an area of 295.28 sq.m. used adjacent to the legal land plot can be transferred free of charge by operation of law. Taking into account that the residential house was built before 2000, the letter N 1864 dated 21.04.2009 of the Arabkir territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia, the conclusion N 20-el-4737 dated 04.05.2009 of the Department of Architecture and Urban Development of the Yerevan City Hall Staff, according to which the land plot occupied by the residential house at 119 A. Khachatryan Street and necessary for its maintenance complies with the requirements set forth in sub-points 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same Code, guided by the Law of the Republic of Armenia "On the status of individual residential houses in Yerevan city for which title documents are not preserved", by the Decision N 2387-N of the Government of the Republic of Armenia dated December 29, 2005 "On approving the procedure for naming, renaming intra-settlement geographical objects in urban and rural settlements of the Republic of Armenia, numbering, addressing and state registration of addresses of real estate according to its location and/or placement, and defining the authorized body for address registration".

  1. Restore Khachatur Leviki Amalyan's right to use the land plot for the property units located at 119 A. Khachatryan Street, to the extent of the land plot with an area of 295.28 sq.m. adjacent to the legal land plot with an area of 600 sq.m. occupied by the residential house and necessary for its maintenance, recognizing his right of ownership to the land plot with an area of 295.28 sq.m. and the buildings and structures located thereon.
  2. The areas of the buildings and structures are subject to clarification by the Arabkir territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the unified master plan issued by the Department of Architecture and Urban Development of the Yerevan City Hall Staff.
  4. Grant an address to the residential house at 119 A. Khachatryan Street: "House N 119, A. Khachatryan Street".
  5. Suggest to the Arabkir territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the right of ownership of citizen Khachatur Leviki Amalyan to the land plot mentioned in point 1 of this decision, to issue a certificate of registration of the right of ownership of real estate, resolving the issues of real estate accounted for as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan City Hall Staff to deliver copies of this decision to the Arabkir district administration within 5 days.
  7. Place the organization and responsibility for the implementation of this decision on the Head of the Department of Architecture and Urban Development of the Yerevan City Hall Staff.
  8. Place the control over the implementation of the decision on A. Sargsyan, Head of the Legal Department of the Yerevan City Hall Staff.
