REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 6493 - Ա, June 30, 2009 ON RESTORING HRANT ASKANAZI MELIK-KAMUSYAN'S PROPERTY RIGHTS TO THE RESIDENTIAL HOUSE AT 87/5 VARDANANTS STREET

The application of Hrant Askanazi Melik-Kamusyan (born 23.02.1956) served as the basis for discussing the issue. According to the citizen's statement, there is no registered right to the property unit at 87/5 Vardanants Street. Taking into account that the residential house was built before 2001, the letters N 104a of 12.01.2009 from the Marash territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia, N 20/2-E/447 of 19.06.2009 from "Land and Property Operations" CJSC of Yerevan City Hall, the conclusion N 20-El-7237 of 15.06.2009 from the Department of Architecture and Urban Development of the Staff of Yerevan City Hall, according to which the land occupied by the residential house at 87/5 Vardanants Street and necessary for its maintenance complies with the requirements defined by sub-points 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same code.

Guided by the RA Law "On the Status of Individual Residential Houses in Yerevan City for which Title Documents are Not Preserved", by the Decision N 2387-N of December 29, 2005 of the Government of the Republic of Armenia "On Approving the Procedure for Naming, Renaming Intra-Settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, Numbering, Addressing and State Registration of Addresses of Real Estate According to its Location and/or Placement, and Defining the Authorized Body for Address Registration".

  1. Restore Hrant Askanazi Melik-Kamusyan's right to land use for the property units located at 87/5 Vardanants Street, to the extent of the land plot of 245.83 sq.m. occupied by the residential house and necessary for its maintenance, recognizing his right of ownership to the land plot of 245.83 sq.m. (of which 144.16 sq.m. is common joint ownership with Arsen Melikamusyan) and the buildings and structures located thereon.
  2. The areas of the buildings and structures are subject to clarification by the Marash territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the master plan issued by the Department of Architecture and Urban Development of the Staff of Yerevan City Hall.
  4. Grant the residential house at 172 Vardanants Street the address: "87/5 Vardanants Street House".
  5. Propose to the Marash territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the ownership right of citizen Hrant Askanazi Melik-Kamusyan to the fixed land plot and building-structure, to provide a certificate of registration of real estate ownership right, resolving the issues of real estate accounted for as a result of inventory.
  6. Instruct the Head of the Secretariat of the Staff of Yerevan City Hall to deliver copies of this decision to the Head of Kentron administrative district within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be placed on the Head of the Department of Architecture and Urban Development of the Staff of Yerevan City Hall.
  8. Control over the implementation of the decision shall be placed on A. Sargsyan, Assistant to the Mayor of Yerevan.
