ON RESTORING THE PROPERTY RIGHTS OF ARAM PETROSI SAFARYAN, SATENIK PETROSI SAFARYAN, ASHKHEN PETROSI SAFARYAN, SARGIS PETROSI SAFARYAN, KARINE NORAYRI ARISTAKESYAN, HAYK GEORGE SAFARYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT 21 MIRAKYAN STREET

The application of Aram Petrosyan Safaryan (born 06.06.1951), Satenik Petrosyan Safaryan (born 16.07.1942), Ashkhen Petrosyan Safaryan (born 20.08.1938), Sargis Petrosyan Safaryan (born 01.01.1940), Karine Norayri Aristakesyan (born 12.09.1955), Hayk George Safaryan (born 22.03.1977) served as the basis for discussing the issue. It was clarified from the topographic survey that the total area of the land plot at 21 Mirakyan Street is actually 628.7 sq.m, of which the land plot with an area of 527 sq.m belongs to Aram Petrosyan Safaryan, Satenik Petrosyan Safaryan, Ashkhen Petrosyan Safaryan, Sargis Petrosyan Safaryan, Karine Norayri Aristakesyan, Hayk George Safaryan by right of ownership. The land plot with an area of 101.7 sq.m, used adjacent to the legal land plot, can be transferred by right of gratuitous ownership by force of law. Taking into account that the residential house was built before 2001, the certificates of inheritance rights dated 05.04.2005 and 29.05.2009, the letters N 132 dated 21.01.2009 of the Shengavit territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia, N 20/2-E/330 dated 07.05.2009 of "Land Property Operations" CJSC of Yerevan City Hall, the conclusion N 20-El-4748 dated 04.05.2009 of the Architecture and Urban Development Department of the Yerevan City Hall Staff, according to which the land plot occupied by the residential house at 21 Mirakyan Street and necessary for its maintenance complies with the requirements defined by subparagraphs 1, 2, 3 of paragraph 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same code, guided by the Law of the Republic of Armenia "On the Status of Individual Residential Houses in Yerevan City for which Confirming Documents are not Preserved", by the Decision N 2387-N of the Government of the Republic of Armenia dated December 29, 2005 "On Approving the Procedure for Naming, Renaming Intra-settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, Numbering, Addressing and State Registration of Addresses of Real Estate According to its Location and/or Placement, and Defining the Authorized Body for Address Registration".

  1. Restore the right of land use of Aram Petrosyan Safaryan, Satenik Petrosyan Safaryan, Ashkhen Petrosyan Safaryan, Sargis Petrosyan Safaryan, Karine Norayri Aristakesyan, Hayk George Safaryan to the property units located at 21 Mirakyan Street, by the size of the land plot with an area of 101.7 sq.m adjacent to the legal land plot with an area of 527 sq.m occupied by the residential house and necessary for its maintenance, recognizing their right of ownership to the land plot with an area of 101.7 sq.m and the buildings located thereon.
  2. The areas of the buildings are subject to clarification by the Shengavit territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the unified master plan provided by the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  4. Assign the address "21 Mirakyan Street House" to the residential house at 21 Mirakyan Street.
  5. Suggest to the Shengavit territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the right of ownership of citizens Aram Petrosyan Safaryan, Satenik Petrosyan Safaryan, Ashkhen Petrosyan Safaryan, Sargis Petrosyan Safaryan, Karine Norayri Aristakesyan, Hayk George Safaryan to the land plot mentioned in point 1 of this decision, to provide a certificate of registration of real estate ownership, resolving the issues of real estate registered as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan City Hall Staff to deliver copies of this decision to the Malatia-Sebastia district administration within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be placed on the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  8. The control over the implementation of the decision shall be placed on A. Sargsyan, Head of the Legal Department of the Yerevan City Hall Staff.
