REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 5820 - A, June 03, 2009

ON RESTORING THE PROPERTY RIGHTS OF SATENIK PARUYRI GALOYAN, VALERIK VOLODI GALOYAN, ARARAT VLADIMIRI GALOYAN TO THE LAND ADJACENT TO THE RESIDENTIAL HOUSE AND BUILDINGS AT NORAGAVIT 1ST STREET, H. 3

The application of Satenik Paruyri Galoyan (born 12.06.1932), Valerik Volodi Galoyan (born 10.11.1956), Ararat Vladimiri Galoyan (born 25.11.1966) served as the basis for discussing the issue. It was clarified from the topographic survey that the total area of the land plot at Noragavit 1st Street, h. 3, actually amounts to 526.37 sq.m., of which the land plot with an area of 226.9 sq.m. belongs to Satenik Paruyri Galoyan, Valerik Volodi Galoyan, Ararat Vladimiri Galoyan by right of ownership. The land plot with an area of 299.4 sq.m. used adjacent to the legal land plot can be transferred free of charge by operation of law. Taking into account that the residential house was built before 2001, the certificate of inheritance right dated 16.10.2008, the letters of the Shengavit territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia dated 26.01.2009, h. 211, and "Land and Property Operations" CJSC of Yerevan City Hall dated 27.05.2009, h. 20/2-E-413, the conclusion of the Architecture and Urban Development Department of the Yerevan City Hall Staff dated 25.05.2009, h. 20-El-6353, according to which the land plot occupied by the residential house at Noragavit 1st Street, h. 3, and necessary for its maintenance, complies with the requirements defined by sub-points 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same code, guided by the Law of the Republic of Armenia "On the Status of Individual Residential Houses in Yerevan City for which Title Documents are Not Preserved", the Decision of the Government of the Republic of Armenia dated December 29, 2005, "On Approving the Procedure for Naming, Renaming Intra-Settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, Numbering, Addressing and State Registration of Addresses of Real Estate According to its Location and/or Placement, and Defining the Authorized Body for Address Registration" h. 2387-N.

  1. Restore the right of land use of Satenik Paruyri Galoyan, Valerik Volodi Galoyan, Ararat Vladimiri Galoyan to the property units located at Noragavit 1st Street, h. 3, to the extent of the land plot with an area of 299.4 sq.m. adjacent to the legal land plot with an area of 226.9 sq.m. occupied by the residential house and necessary for its maintenance, recognizing their right of ownership to the land plot with an area of 299.4 sq.m. and the buildings and structures located thereon.
  2. The areas of the buildings and structures are subject to clarification by the Shengavit territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the unified master plan provided by the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  4. Assign the address "Noragavit 1st Street, h. 3 house" to the residential house at Noragavit 1st Street, h. 3.
  5. Propose to the Shengavit territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the right of ownership of citizens Satenik Paruyri Galoyan, Valerik Volodi Galoyan, Ararat Vladimiri Galoyan to the land plot mentioned in point 1 of this decision, to provide a certificate of registration of real estate ownership, resolving the issues of real estate accounted for as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan City Hall Staff to deliver copies of this decision to the Shengavit district administration within 5 days.
  7. The organization and responsibility for the execution of this decision shall be placed on the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  8. Control over the execution of the decision shall be placed on A. Sargsyan, Head of the Legal Department of the Yerevan City Hall Staff.
