REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 5821 - Ա, June 03, 2009 ON RESTORING ALVARD ABRAHAMI HAKOBYAN'S PROPERTY RIGHTS TO THE RESIDENTIAL HOUSE AT 20/18 SHAHAMIRYAN STREET

The application of Alvard Abrahami Hakobyan (born 03.01.1963) served as the basis for discussing the issue. According to the citizen's statement, there is no registered right to the property unit at 20/18 Shahamiryan Street. Taking into account that the residential house was built before 1962, the letter N 20/2-Ե/422 dated 02.06.2009 of "Land and Property Operations" CJSC of Yerevan City Hall, the conclusion N 20-Ել-6607 dated 29.05.2009 of the Architecture and Urban Development Department of the Yerevan City Hall staff, according to which the land plot occupied by the residential house at 20/18 Shahamiryan Street and necessary for its maintenance complies with the requirements defined by sub-points 1, 2, 3 of point 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same Code.

Guided by the RA Law "On the Status of Individual Residential Houses with Undocumented Rights in Yerevan City", by the RA Government Decision N 2387-N of December 29, 2005 "On Approving the Procedure for Naming, Renaming Intra-settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, Numbering, Addressing and State Registration of Addresses of Real Estate According to its Location and/or Placement, and Defining the Authorized Body for Address Registration".

  1. Restore Alvard Abrahami Hakobyan's land use right to the property units located at 20/18 Shahamiryan Street, to the extent of the land plot with an area of 94.92 sq.m. occupied by the residential house and necessary for its maintenance, recognizing her ownership right to the land plot with an area of 94.92 sq.m. (of which 19.95 sq.m. is common joint property with Hmayak Igityan and Arsen Serzhiki Grigoryan) and the buildings located on it.
  2. The areas of the buildings are subject to clarification by the Erebuni territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the master plan provided by the Architecture and Urban Development Department of the Yerevan City Hall staff.
  4. Grant the residential house at 20 Shahamiryan Street the address: "20/18 Shahamiryan Street".
  5. Propose to the Erebuni territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the ownership right of citizen Alvard Abrahami Hakobyan to the registered land plot and building, to provide a certificate of registration of real estate ownership, resolving the issues of real estate recorded as a result of inventory.
  6. Instruct the head of the secretariat of the Yerevan City Hall staff to send copies of this decision to the Shengavit district administration within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be assigned to the head of the Architecture and Urban Development Department of the Yerevan City Hall staff.
  8. Control over the implementation of the decision shall be assigned to A. Sargsyan, head of the Legal Department of the Yerevan City Hall staff.
