On restoring the property rights of Styopa Paruyri Avayan concerning residential house No. 17/14 on Myasnikyan Avenue

REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 6497 - A, June 30, 2009 ON RESTORING THE PROPERTY RIGHTS OF STYOPA PARUYRI AVAYAN TO THE RESIDENTIAL BUILDING AT MYASNIKYAN AVENUE H.17/14

The application of Styopa Paruyri Avayan (born 03.07.1938) served as the basis for discussing the issue. According to the citizen's statement, there is no registered right to the property unit at Myasnikyan Avenue h.17/14. Taking into account that the residential building was constructed before 2001, the conclusion of the Architecture and Urban Development Department of the Yerevan City Hall Staff dated 23.06.2009, h.20-El-7636, according to which the land plot occupied by the residential building at Myasnikyan Avenue h.17/14 and necessary for its maintenance complies with the requirements defined by subparagraphs 1, 2, 3 of paragraph 2 of Article 64 of the RA Land Code and is not included in the list of restrictions provided for by Article 60 of the same code.

Guided by the RA Law "On the Status of Individual Residential Buildings in Yerevan City for which Title Documents are Not Preserved", the RA Government's Decision N 2387-N of December 29, 2005, "On Approving the Procedure for Naming, Renaming Intra-Settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, Numbering, Addressing and State Registration of Addresses of Real Estate According to its Location and/or Placement, and Defining the Authorized Body for Address Registration".

  1. Restore Styopa Paruyri Avayan's right to land use for the property units located at Myasnikyan Avenue h.17/14, to the extent of the land plot of 297.25 sq.m. occupied by the residential building and necessary for its maintenance, recognizing his right of ownership to the land plot of 297.25 sq.m. (of which 46.09 sq.m. is common joint ownership with Avag Avayan) and the buildings and structures located thereon.
  2. The areas of the buildings and structures are subject to clarification by the Marash territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the master plan issued by the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  4. Assign the address "Myasnikyan Avenue h.17/14 house" to the residential building at Myasnikyan Avenue h.17/2.
  5. Propose to the Marash territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the ownership right of citizen Styopa Paruyri Avayan to the registered land plot and building-structure, provide a certificate of registration of real estate ownership right, resolving the issues of real estate accounted for as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan City Hall Staff to deliver copies of this decision to the Head of the Kentron administrative district within 5 days.
  7. The organization and responsibility for the implementation of this decision shall be placed on the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  8. Control over the implementation of the decision shall be placed on A. Sargsyan, Assistant to the Mayor of Yerevan.
