ON RESTORING PROPERTY RIGHTS OF ARA ANDRANIKI TOVMASYAN OVER THE RESIDENTIAL BUILDING AT SHIRAKI STR. 45/65

The discussion of the issue was based on the application of Ara Andraniki Tovmasyan (born 04/26/1952). According to the citizen's statement, there is no registered property right over the property unit at the address Shiraki Str. 45/65.

Considering that the residential building was constructed before 2001, the letter of the "Land and Property Operations" SNCO of the Yerevan Municipality dated 06/25/2009 No. 20/2-Ye/456, the conclusion of the Department of Architecture and Urban Planning of the Staff of the Yerevan Municipality dated 06/22/2009 No. 20-YeL-7549, according to which the land plot occupied by the residential building at Shiraki Str. 45/65 and necessary for its maintenance meets the requirements defined by sub-points 1, 2, 3 of Article 64, Part 2 of the RA Land Code and is not included in the list of restrictions provided by Article 60 of the same Code.

Guided by the RA Law "On the Status of Individual Residential Houses in Yerevan City for Which Documents Confirming the Right Are Not Preserved", Decision No. 2387-N of the RA Government dated December 29, 2005 "On Approving the Procedure for Naming, Renaming, Numbering, Addressing, and State Registration of Addresses of Intra-settlement Geographical Objects in Urban and Rural Settlements of the Republic of Armenia, and Designating the Authorized Body for Address Registration":

  1. Restore the land use right of Ara Andraniki Tovmasyan over the property units at the address Shiraki Str. 45/65, in the amount of a 267.07 sq.m. land plot occupied by the residential building and necessary for its maintenance; recognize his ownership right over the 267.07 sq.m. land plot and the buildings and structures located on it.
  2. The areas of the buildings and structures are subject to clarification by the Shengavit Territorial Division of the State Committee of the Real Estate Cadastre Adjacent to the RA Government.
  3. The boundaries of the land plot are determined by the master plan issued by the Department of Architecture and Urban Planning of the Staff of the Yerevan Municipality.
  4. Provide the residential building at the address Shiraki auxiliary economy No. 45 with the address: "Building No. 45/65, Shiraki Street".
  5. Propose to the Shengavit Territorial Division of the State Committee of the Real Estate Cadastre Adjacent to the RA Government to register the ownership right of citizen Ara Andraniki Tovmasyan over the secured land plot and building and structures, to issue a certificate of registration of the real estate ownership right, resolving the issues of real estate registered as a result of inventory.
  6. Assign the Head of the Secretariat of the Staff of the Yerevan Municipality to send copies of this decision to the Head of the Shengavit Administrative District within a 5-day period.
  7. The organization and responsibility for the execution of this decision shall be vested in the Head of the Department of Architecture and Urban Planning of the Staff of the Yerevan Municipality.
  8. Control over the execution of the decision shall be vested in the Assistant to the Mayor of Yerevan, A. Sargsyan.
