The decision restores Arsen Hamoyi Melikamasyan's right to land use for the 259.33 sq m land plot located at Vardanants Street N 87/4 and recognizes his ownership rights to the land plot and the buildings and structures on it.

DECISION N 6494 - A, June 30, 2009

ON PARTIALLY ANNULING APPENDIX N 1 OF YEREVAN MAYOR’S DECISION N 404-A OF MARCH 15, 2004, AND RESTORING ARSEN HAMOYI MELIKAMUSYAN’S PROPERTY RIGHTS TO THE RESIDENTIAL HOUSE N 87/4 ON VARDANANTS STREET

The application of Arsen Hamoyi Melikamusyan (born 12.03.1957) served as the basis for discussing the issue. According to the citizen's statement, there is no registered right to the property unit at 87/4 Vardanants Street. Taking into account that the residential house was built before 1925, the letters N 105a of 12.01.2009 from the Marash territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia, and N 20/2-E/447 of 19.06.2009 from "Land and Property Operations" CJSC of Yerevan City Hall, the conclusion N 20-El-4677 of 04.05.2009 from the Architecture and Urban Development Department of the Yerevan City Hall staff, according to which the land plot occupied by the residential house at 87/4 Vardanants Street and necessary for its maintenance complies with the requirements defined by subparagraphs 1, 2, 3 of paragraph 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of restrictions provided for by Article 60 of the same code. Guided by the Law of the Republic of Armenia "On the status of individual residential houses in Yerevan for which title documents have not been preserved", and by the Decision N 2387-N of December 29, 2005, of the Government of the Republic of Armenia "On approving the procedure for naming, renaming intra-settlement geographical objects in urban and rural settlements of the Republic of Armenia, numbering, addressing and state registration of addresses of real estate according to its location and/or placement, and defining the authorized body for address registration".

  1. Annul point 89 of Appendix N 1 of Decision N 404-A of March 15, 2004, and the master plan issued on its basis.
  2. Restore Arsen Hamoyi Melikamusyan's land use right to the property units located at 87/4 Vardanants Street, to the extent of the land plot of 259.33 sq.m. occupied by the residential house and necessary for its maintenance, recognizing his ownership right to the land plot of 259.33 sq.m. (of which 144.16 sq.m. is common joint ownership with Hrant Melik-Kamusyan) and the buildings and structures located thereon.
  3. The areas of the buildings and structures are subject to clarification by the Marash territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  4. The boundaries of the land plot are determined by the master plan provided by the Architecture and Urban Development Department of the Yerevan City Hall staff.
  5. Grant the residential house at 172 Vardanants Street the address: "House N 87/4 Vardanants Street".
  6. Propose to the Marash territorial subdivision of the State Committee of Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the ownership right of citizen Arsen Hamoyi Melikamusyan to the registered land plot and building-structure, to provide a certificate of registration of real estate ownership right, resolving the issues of real estate accounted for as a result of inventory.
  7. Instruct the head of the secretariat of the Yerevan City Hall staff to deliver copies of this decision to the head of the Kentron administrative district within 5 days.
  8. The organization and responsibility for the implementation of this decision shall be placed on the head of the Architecture and Urban Development Department of the Yerevan City Hall staff.
  9. The control over the implementation of the decision shall be placed on A. Sargsyan, Assistant to the Mayor of Yerevan.
