ON RESTORATION OF PROPERTY RIGHTS OF MARTIK VARAZDATI ASATRYAN OVER THE RESIDENTIAL HOUSE AT VERIN SHENGAVIT 2ND STREET, H. 47/3

Restore Martik Varazdat Asatryan's land use right over the property units located at 47/3 Verin Shengavit 2nd Street, recognizing his ownership right over the 26.95 sq.m. land plot and the buildings and structures located on it. The areas of the buildings and structures are subject to clarification, the boundaries of the land plot are determined by the master plan. Assign an address to the residential house at 61 Verin Shengavit 2nd Street: "House 47/3 Verin Shengavit 2nd Street". The State Cadastre Committee is recommended to register the ownership right and issue a certificate. Copies of the decision shall be delivered to the Shengavit district administration within 5 days. The organization and responsibility for the implementation shall be assigned to the head of the Department of Architecture and Urban Development, and the supervision to the head of the Legal Department.

REPUBLIC OF ARMENIA MAYOR OF YEREVAN DECISION N 5818 - Ա, June 03, 2009 ON RESTORING THE PROPERTY RIGHTS OF MARTIK VARAZDATI ASATRYAN TO THE RESIDENTIAL HOUSE AT 47/3, 2ND STREET OF VERIN SHENGAVIT

The application of Martik Varazdati Asatryan (born 03.03.1959) served as the basis for discussing the issue. According to the citizen's statement, there is no registered right to the property unit at 47/3, 2nd Street of Verin Shengavit. Taking into account that the residential house was built before 1954, the letter N 20/2-Ե/357 dated 13.05.2009 of "Land and Property Operations" CJSC of Yerevan City Hall, the conclusion N 20-Ել-5163 dated 08.05.2009 of the Architecture and Urban Development Department of the Yerevan City Hall Staff, according to which the land occupied by the residential house at 47/3, 2nd Street of Verin Shengavit and necessary for its maintenance complies with the requirements defined by sub-points 1, 2, 3 of point 2 of Article 64 of the RA Land Code and is not included in the list of restrictions provided for by Article 60 of the same code.

Guided by the RA Law "On the status of individual residential houses with unpreserved title documents in the city of Yerevan", the RA Government Decision N 2387-N of December 29, 2005 "On approving the procedure for naming, renaming intra-settlement geographical objects in urban and rural settlements of the Republic of Armenia, numbering, addressing and state registration of addresses of real estate according to its location and/or placement, and defining the authorized body for address registration".

  1. Restore Martik Varazdati Asatryan's right to land use for the property units located at 47/3, 2nd Street of Verin Shengavit, to the extent of the land plot with an area of 26.95 sq.m. occupied by the residential house and necessary for its maintenance, recognizing his right of ownership to the land plot with an area of 26.95 sq.m. and the buildings and structures located thereon.
  2. The areas of the buildings and structures are subject to clarification by the Erebuni territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the master plan provided by the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  4. Provide an address to the residential house at 61, 2nd Street of Verin Shengavit: "House 47/3, 2nd Street of Verin Shengavit".
  5. Suggest to the Erebuni territorial subdivision of the State Committee of the Real Estate Cadastre adjunct to the Government of the Republic of Armenia to register the ownership right of citizen Martik Varazdati Asatryan to the registered land plot and building-structure, to provide a certificate of registration of real estate ownership right, resolving the issues of real estate registered as a result of inventory.
  6. Instruct the Head of the Secretariat of the Yerevan City Hall Staff to deliver copies of this decision to the Shengavit district administration within 5 days.
