ON CHANGING THE TARGET AND FUNCTIONAL PURPOSES OF THE LAND PLOT
LOCATED AT YEREVAN MALATIA-SEBASTIA HAGHTANAK DISTRICT H.25-4 ADDRESS

The basis for the adoption of the administrative act was the application of Vahe Hambardzumyan to change the target and functional purposes of the land plot with cadastral code 01-007-0176-0144, owned by Vahe Hambardzumyan by right of ownership, located at Yerevan Malatia-Sebastia Haghtanak district h.25-4, as well as the state registration certificate of rights to real estate No. 13012026-01-0168, according to which the target purpose of the land plot is agricultural, and the functional purpose or land type is arable land.

The basis for the discussion of the issue was the state registration certificate of rights to real estate No. 13012026-01-0168 dated January 13, 2026, letters from "Electric Networks of Armenia" CJSC No. DG3154 dated April 08, 2026, "Veolia Jur" CJSC No. MSH/9321 dated March 27, 2026, "Gazprom Armenia" CJSC No. 53/53.13/1900-2026 dated March 24, 2026, "High-Voltage Electric Networks" CJSC No. /22.4/1748-2026 dated March 27, 2026, and "Telecom Armenia" CJSC No. 741/26-1 dated March 23, 2026.

According to the general plan of the city of Yerevan approved by the decision of the Council of Elders of the City of Yerevan of the Republic of Armenia No. 204-N dated September 10, 2024, the land plot is located in the mixed development zone of settlement lands.

The land plot under consideration is not included in the list of restrictions of Article 60 of the Land Code of the Republic of Armenia. According to the annexes approved by the decision of the Government of the Republic of Armenia No. 1023-N dated June 4, 2020, according to the agreed spatial evaluation scheme, the land plot is located in zone 12.

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 7 (paragraphs 4 and 5) and 10 (paragraphs 1 and 2) of the Land Code, Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Proceedings", Article 14.3 (part 12) of the Law "On Urban Development", based on the 2024 decision of the Council of Elders of the City of Yerevan

DECISION

decision No. 204-N of September 10, taking into account the conclusion of the Department of Architecture and Urban Development of the Yerevan City Hall staff.

  1. In accordance with the conditional symbols enshrined in the general plan of Yerevan city approved by decision No. 204-N of September 10, 2024, of the Council of Elders of the City of Yerevan, to define the target designation of the land plot with cadastral code 01-007-0176-0144, with an area of 0.1127 ha, located at Yerevan, Malatia-Sebastia Haghutan district No. 25-4, owned by Vahe Babkeni Hambardzumyan, as residential areas, and its functional designation as residential development, in accordance with sub-point 3 of point 24 of the procedure approved by decision No. 1920-N of December 29, 2011, of the Government of the Republic of Armenia (purpose of use).
  2. The rights to the land plot with the changed target and functional designations are subject to state registration in the Cadastre Committee of the Republic of Armenia, in accordance with the attached design permit (architectural and planning task).
  3. Take note that the state registration of the right to change the target and functional designations of the land plot on the basis of this decision is subject to implementation if the owner has paid the difference between the cadastral value approximated to the market value of the land plot at that time.
  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  5. The organization and responsibility for the execution of the decision shall be assigned to the head of the Department of Architecture and Urban Development of the Yerevan City Hall and the head of the Malatia-Sebastia administrative district.
  6. Control over the implementation of this decision is ensured by the Secretary of the Yerevan City Hall staff.
