On changing the purpose and functional designation of the land plot located at Malatia-Sebastia district, Yerevan

This decision changes the purpose and functional designation of a land plot in the Malatia-Sebastia district of Yerevan. The land plot, with cadastral code 01-007-0170-0185 and an area of 1.07675 hectares, will now be designated for residential areas with a functional designation of public construction. The changes are in accordance with the main plan of Yerevan and require state registration. The owner must pay the difference between the cadastral and market value for the registration to be completed. The execution of the decision is entrusted to the Department of Architecture and Urban Planning and the head of the Malatia-Sebastia district, with oversight from the Secretary of the Yerevan Municipality Staff.

DECISION OF THE MAYOR OF YEREVAN

ON CHANGING THE TARGET AND FUNCTIONAL DESIGNATIONS OF THE LAND PLOT LOCATED AT MALATIA-SEBASTIA ADDRESS IN YEREVAN

The basis for the adoption of the administrative act was Narek Manvelyan's application to change the target and functional designations of the land plot with cadastral code 01-007-0170-0185, owned by Narek Manvelyan by right of ownership, located at Malatia-Sebastia address in Yerevan, as well as the state registration certificate of rights to immovable property No. 22042026-01-0323, according to which the target designation of the land plot is agricultural, and the functional designation or land type is arable land.

The basis for the discussion of the issue were the state registration certificate of rights to immovable property No. 22042026-01-0323 dated April 22, 2026, the letters of "Electric Networks of Armenia" CJSC No. DG5336 dated June 18, 2026, "Veolia Jur" CJSC No. MSH/21500 dated June 22, 2026, "Gazprom Armenia" CJSC No. 53/53.13/4399-2026 dated July 2, 2026, "Telecom Armenia" CJSC No. 1609/26-1 dated June 24, 2026, and "High Voltage Electric Networks" CJSC No. /22.2/3687-2026 dated June 25, 2026.

According to the general plan of Yerevan approved by the decision of the Yerevan City Council No. 204-N dated September 10, 2024, the land plot is located in the zone of mixed development lands with a residential target designation.

The land plot under consideration is not included in the list of restrictions of Article 60 of the Land Code of the Republic of Armenia. According to the annexes approved by the decision of the Government of the Republic of Armenia No. 1023-N dated June 4, 2020, according to the agreed spatial assessment scheme, the land plot is located in zone 12.

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 7 (paragraphs 4 and 5) and 10 (paragraphs 1 and 2) of the Land Code, Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Procedure", Article 14.3 (part 12) of the Law "On Urban Development", taking as a basis the decision of the Yerevan City Council No. 204-N dated September 10, 2024, and taking into account the conclusion of the Department of Architecture and Urban Development of the Yerevan City Hall Staff.

DECISION NO. 24-A OF THE MAYOR OF YEREVAN DATED JANUARY 19, 2024

  1. In accordance with the conventional signs stipulated in the general plan of Yerevan city approved by decision No. 204-N of the Yerevan City Council dated September 10, 2024, the land plot with cadastral code 01-007-0170-0185, with an area of 1.07675 ha, located at Malatia-Sebastia, Yerevan, owned by Narek Manvelyan by right of ownership, shall have its targeted designation set as residential areas, and its functional designation as public construction, in accordance with sub-point 3 of point 24 of the procedure approved by decision No. 1920-N of the Government of the Republic of Armenia dated December 29, 2011 (purpose of use).
  2. The rights to the land plot with the changed targeted and functional designations are subject to state registration in the Cadastre Committee of the Republic of Armenia, in accordance with the attached design permit (architectural and planning assignment).
  3. It shall be noted that the state registration of the right to change the targeted and functional designations of the land plot on the basis of this decision is subject to implementation if the owner has paid the difference between the cadastral value approximated to the market value of the land plot effective at that time.
  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  5. The organization and responsibility for the execution of the decision shall be assigned to the head of the Architecture and Urban Development Department of the Yerevan Municipality and the head of the Malatia-Sebastia administrative district.
  6. Control over the implementation of this decision shall be ensured by the Secretary of the Staff of the Yerevan Municipality.
