On changing the targeted and functional designations of the land plot, Malatia-Sebastia Haghtanak 110th district H1 and H1A address

This decision refers to the change of targeted and functional designations of the land plot located at H1 and H1A addresses of Haghntanak 110th district of Malatia-Sebastia administrative district of Yerevan city. The targeted designation of the land plot is defined as residential areas, and the functional designation as residential development. The decision is based on the conclusion of the Department of Architecture and Urban Development of the City Hall.

ON CHANGING THE TARGET AND FUNCTIONAL PURPOSES OF THE LAND PLOT LOCATED AT YEREVAN MALATIA-SEBASTIA HAGHTANAK 110TH SECTION H1 AND H1A ADDRESS

The basis for the adoption of the administrative act was the application of Artur Kumelov's attorney Vardan Sahakyan regarding the change of the target and functional purposes of the land plot with cadastral code 01-007-0160-0063, owned by Artur Kumelov, located at Yerevan Malatia-Sebastia Haghtanak 110th section H1 and H1A address, as well as the state registration certificate of rights to real estate No. 25122023-01-0375, according to which the target purpose of the land plot is agricultural, and the functional purpose or land use is arable land.

The basis for the discussion of the issue were the state registration certificate of rights to real estate No. 25122023-01-0375 dated December 25, 2023, the letters of "Electric Networks of Armenia" CJSC No. DG4654 dated May 25, 2026, "Veolia Jur" CJSC No. MSH/12646 dated April 17, 2025, "Gazprom Armenia" CJSC No. 53/53.13/3534-2026 dated May 25, 2026, "High-Voltage Electric Networks" CJSC No. /22.2/2922-2026 dated May 21, 2026, and "Telecom Armenia" CJSC No. 1361/26-1 dated May 22, 2026.

According to the general plan of the city of Yerevan approved by the decision of the Council of Elders of the City of Yerevan of the Republic of Armenia No. 204-N dated September 10, 2024, the land plot is located in the mixed development zone of settlement lands.

The land plot under consideration is not included in the list of restrictions of Article 60 of the Land Code of the Republic of Armenia. According to the annexes approved by the decision of the Government of the Republic of Armenia No. 1023-N dated June 4, 2020, according to the agreed spatial assessment scheme, the land plot is located in zone 12.

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 7, paragraphs 4 and 5, and Article 10, paragraphs 1 and 2 of the Land Code, Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Procedure", Article 14.3 of the Law "On Urban Development"

by part 12 of the article, based on decision No. 204-N of the Council of Elders of the City of Yerevan dated September 10, 2024, taking into account the conclusion of the Department of Architecture and Urban Development of the Yerevan City Hall staff.

  1. According to the conditional symbols enshrined in the general plan of the City of Yerevan approved by decision No. 204-N of the Council of Elders of the City of Yerevan dated September 10, 2024: to define the targeted designation of the land plot with cadastral code 01-007-0160-0063, with an area of 0.31004 hectares, located at Yerevan, Malatia-Sebastia Haghthanak 110th section H1 and H1A, owned by Artur Sergey Kumelov by right of ownership, as residential areas, and the functional designation as: residential development, in accordance with sub-point 3 of point 24 of the procedure approved by decision No. 1920-N of the Government of the Republic of Armenia dated December 29, 2011 (purpose of use).
  2. The rights to the land plot with the changed targeted and functional designations are subject to state registration in the Cadastre Committee of the Republic of Armenia, in accordance with the attached design permit (architectural and planning assignment).
  3. Take note that the state registration of the right to change the targeted and functional designations of the land plot on the basis of this decision is subject to implementation if the amount of the difference in the cadastral value approximated to the market value of the land plot operating at that time has been paid by the owner.
  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  5. The organization and responsibility for the execution of the decision shall be placed on the head of the Department of Architecture and Urban Development of the Yerevan City Hall and the head of the Malatia-Sebastia administrative district.
  6. Control over the implementation of this decision is ensured by the Secretary of the Yerevan City Hall staff.
