ON ALIENATION OF AN ADDITIONAL LAND PLOT THROUGH DIRECT SALE AND PROVISION OF AN ADDRESS

The basis for the adoption of the administrative act was the letter of "QUANT" SCIENTIFIC-EDUCATIONAL AC in the framework of investment programs, regarding the provision of the land plot adjacent to the land plot located at Araratyan street h.4, owned by right of ownership (state registration of rights to real estate 08.08.2025 h.08082025-01-0208 certificate) as an expansion, for development purposes, through direct sale, as well as the letter of the Urban Development Committee of the Republic of Armenia 01/11.1/4477-2026 (13616-26).

It was revealed from the clarification of the topographic survey that the actual area of the land plot under consideration for additional provision for expansion purposes is 552.30 sq.m., the contour dimensions and position of which do not allow it to become a separate object of public bidding, it corresponds to sub-point 2 of point 1 of the decision h.550-N of May 26, 2016, of the Government of the Republic of Armenia, namely: the alienated land plot is adjacent to the expanding land plot and, depending on the position, relief or dimensions of the alienated land plot, in accordance with urban planning norms, it can be used exclusively for the purpose of servicing the building or structure located on the expanding land plot or for their reconstruction, strengthening, restoration, modernization and improvement works.

According to the general plan of Yerevan city approved by the decision h.204-N of September 10, 2024, of the Council of Elders of Yerevan city, the land plot under consideration is located in the zone of lands for general use of settlements and, according to the annexes approved by the decision h.1023-N of June 4, 2020, of the Government of the Republic of Armenia, it is located in the 5th zone of the agreed scheme for land valuation of Yerevan city (code: 01-011-0361-0001, decision h.456-N of May 3, 2012, of the Council of Elders of Yerevan city, line: 42552).

Guided by Article 49 of the Law "On Local Self-Government in Yerevan City", "On the Fundamentals of Administration and Administrative Procedure"

by Articles 3, 53, 59 and 60 of the Law, by the Law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax", by Decision No. 1023-N of the Government of the Republic of Armenia dated June 4, 2020, by Article 59 of the Land Code, by point 8 of part 1 of Article 66, by sub-point 2 of point 1 of Decision No. 550-N of the Government of the Republic of Armenia dated May 26, 2016, by Decision No. 2387-N dated December 29, 2005, by the appendix to Decision No. 463-N of the Yerevan City Council dated December 23, 2025, taking into account the conclusion No. N/42547-26 of the Department of Architecture and Urban Development of the Yerevan Municipality Staff.

  1. Establish that the area of the land plot adjacent to Yerevan, Shengavit Araratyan street h.4, which is communal property, is 552.30 sq.m.
  2. According to the general plan of Yerevan approved by Decision No. 204-N of the Yerevan City Council dated September 10, 2024, define the targeted purpose of the land plot with an area of 552.30 sq.m. adjacent to Yerevan, Shengavit Araratyan street h.4 as settlements, and the functional purpose (purpose of use) as public development, in accordance with sub-point 3 and sub-point "a" of point 4 of point 24 of the procedure approved by Decision No. 1920-N of the Government of the Republic of Armenia dated December 29, 2011, which is not classified among the land plots defined by Article 60 of the Land Code of the Republic of Armenia.
  3. The boundaries of the land plot are determined by the plan approved in the established procedure.
  4. Assign the address "Araratyan street, h.4/1" to the land plot with an area of 552.30 sq.m. adjacent to Yerevan, Shengavit Araratyan street h.4.
  5. After registering the land plot with an area of 552.30 sq.m. adjacent to Yerevan, Shengavit Araratyan street h.4 in the name of the Yerevan community, alienate (sell) it as an expansion, for development purposes, by direct sale with the right of ownership to "KVANT" SCIENTIFIC-EDUCATIONAL AK at the cadastral value approximated to the market value of the 5th zone of area valuation valid at the time of the decision, which amounts to 32534888 (thirty-two million five hundred thirty-four thousand eight hundred eighty-eight) AMD and transfer it to account 900015211320 of the Yerevan Municipality (income from land alienation).
  6. Authorize the head of the Real Estate Management Department of the Yerevan Municipality Staff to:
  1. ensure the state registration works of the land plot mentioned in point 1 of this decision in the name of the Yerevan community.
  2. after submitting the documents confirming the payment of the cadastral value approximated to the market value of the land plot and the local fee, and after carrying out the state registration of the right in the name of the Yerevan community, within three working days, conclude a contract for the sale and purchase of the land plot with "KVANT" SCIENTIFIC-EDUCATIONAL AK on behalf of the Mayor of Yerevan.
  1. Instruct the head of the Real Estate Management Department of the Yerevan Municipality Staff to

information about the address to the RA Cadastre Committee and the relevant department of the Yerevan City Police of the Republic of Armenia, to the head of the Shengavit administrative district within three working days.

  1. Establish that in case the cadastral value approximated to the market value of the land plot is not paid by the acquirer of the land plot within 15 days from the moment of adoption of this decision, point 5 and sub-point 2 of point 6 of the decision shall be considered null and void.

  2. Take note that all expenses for state registration of property rights arising from this decision, approval of the land plot plan, provision of an address, notarization of the contract, as well as obtaining a unified certificate provided by law, and other necessary payments are made at the expense of "QUANT" SCIENTIFIC-EDUCATIONAL JSC.

  3. Take note that the sale and purchase agreement is subject to notarization, and the right arising from the agreement is subject to state registration in the RA Cadastre Committee in accordance with the design permit /architectural and planning task/ attached to this decision.

  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.

  5. The organization and responsibility for the execution of the decision shall be assigned to the heads of the Architecture and Urban Development, and Real Estate Management departments of the Yerevan Municipality staff.

  6. Control over the implementation of this decision is ensured by the Secretary of the Yerevan Municipality staff.
