ON CHANGING THE TARGET AND FUNCTIONAL DESIGNATIONS OF THE LAND PLOT LOCATED AT YEREVAN MALATIA-SEBASTIA HAGHTANAK DISTRICT 51, PLOT H.3

The basis for the adoption of the administrative act was the application of Nver Margaryan's attorney Artak Dallakyan to change the target and functional designations of the land plot with cadastral code 01-007-0138-0122, owned by Nver Margaryan, located at Yerevan Malatia-Sebastia Haghtanak district 51, plot H.3, as well as the state registration certificate of rights to immovable property No. 20042026-01-0177, according to which the target designation of the land plot is agricultural, and the functional designation or land type is arable land.

The basis for the discussion of the issue was the state registration certificate of rights to immovable property No. 20042026-01-0177 dated April 20, 2026, the letters of "Electric Networks of Armenia" CJSC No. DG4509 dated May 15, 2026, "Veolia Jur" CJSC No. MSH/16511 dated May 21, 2026, "Gazprom Armenia" CJSC No. 53/53.13/3264-2026 dated May 18, 2026, "High-Voltage Electric Networks" CJSC No. /22.3/2750-2026 dated May 14, 2026, and "Telecom Armenia" CJSC No. 1287/26-1 dated May 19, 2026. According to the general plan of Yerevan approved by the decision of the Council of Elders of the City of Yerevan No. 204-N dated September 10, 2024, the land plot is located in the zone of mixed development lands of settlements.

The land plot under consideration is not included in the list of restrictions of Article 60 of the Land Code of the Republic of Armenia. According to the annexes approved by the decision of the Government of the Republic of Armenia No. 1023-N dated June 4, 2020, according to the agreed spatial assessment scheme, the land plot is located in zone 9.

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 7 (paragraphs 4 and 5) and 10 (paragraphs 1 and 2) of the Land Code, Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Procedure", Article 14.3 (part 12) of the Law "On Urban Development", based on the decision of the Council of Elders of the City of Yerevan dated September 10, 2024,

h.204-N decision, taking into account the conclusion of the Department of Architecture and Urban Development of the Yerevan City Hall staff.

  1. In accordance with the conditional symbols enshrined in the General Plan of Yerevan City approved by the h.204-N decision of September 10, 2024, of the Council of Elders of Yerevan City, to define the targeted designation of the land plot located at Yerevan, Malatia-Sebastia Haghthanak district, plot 51, land plot h.3, owned by Nver Alberti Margaryan by right of ownership, with cadastral code 01-007-0138-0122, with an area of 0.02634 ha, as residential areas, and the functional designation as residential development, in accordance with sub-point 3 of point 24 of the procedure approved by the h.1920-N decision of December 29, 2011, of the Government of the Republic of Armenia (purpose of use).
  2. The rights to the land plot with the changed targeted and functional designations are subject to state registration in the Cadastre Committee of the Republic of Armenia, in accordance with the attached design permit (architectural and planning task).
  3. Take into account that the state registration of the right to change the targeted and functional designations of the land plot on the basis of this decision is subject to implementation if the amount of the difference in the cadastral value approximated to the market value of the land plot operating at that time has been paid by the owner.
  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  5. The organization and responsibility for the execution of the decision shall be placed on the head of the Department of Architecture and Urban Development of the Yerevan City Hall and the head of the Malatia-Sebastia administrative district.
  6. Control over the implementation of this decision is ensured by the Secretary of the Yerevan City Hall staff.
