ON CHANGING THE TARGET AND FUNCTIONAL DESIGNATIONS OF THE LAND PLOT LOCATED AT MOLDOVAKAN STREET, H.45/6

The basis for the adoption of the administrative act was the application of Kristina Nalbandyan, legal representative of "Aviasarq" CJSC, to change the designations of the 0.743 ha land plot (cadastral code: 01-008-0507-1283) belonging to the company by the state registration certificate of rights to real estate, located at Yerevan, Nor Nork administrative district, Moldovakan street h.45/6, from industrial, subsoil use and other industrial target and industrial object designations to settlement target designation and residential development, respectively.

The basis for the discussion of the issue were the state registration certificate of rights to real estate no. 31102024-01-0365, the letters of "Gazprom Armenia" CJSC dated 22.05.2025 no. 53/53.13/3709-2025, "High-Voltage Electric Networks" CJSC, "Electric Networks of Armenia" CJSC dated 12.05.2025 no. DG-4193, "Veolia Jur" CJSC dated 07.05.2025 no. MSH/15066 and the conclusion of the Architecture and Urban Development Department of the staff no. D-45075-26.

According to the General Plan of Yerevan approved by the decision of the Council of Elders of the City of Yerevan no. 204-N dated September 10, 2024, the land plot at Moldovakan street, h.45/6 is located in the mixed development zone of settlement target designation.

According to the annexes approved by the decision of the Government of the Republic of Armenia no. 1023-N dated June 4, 2020, according to the agreed spatial assessment scheme, the land plot is located in zone 7.

Guided by Article 49 of the Law of the Republic of Armenia "On Local Self-Government in the City of Yerevan", Articles 7, paragraphs 4 and 5, Article 10, paragraphs 1 and 2 of the Land Code of the Republic of Armenia, Articles 3, 53, 59 and 60 of the Law of the Republic of Armenia "On the Fundamentals of Administration and Administrative Procedure", Article 14, part 12 of the Law of the Republic of Armenia "On Urban Development",

  1. In accordance with the General Plan of Yerevan City approved by decision No. 204-N of September 10, 2024, of the Council of Elders of the City of Yerevan: to define the targeted designation (category) of the 0.743 ha land plot located at Nor Nork administrative district, Moldovakan street, No. 45/6, owned by "Aviasark" CJSC, as residential areas, and the functional designation (purpose of use) as residential development, in accordance with sub-point 3 of point 24 of the procedure approved by decision No. 1920-N of December 29, 2011, of the Government of the Republic of Armenia.
  2. The rights to the land plot with the changed targeted and functional designations are subject to state registration in the Cadastre Committee of the Republic of Armenia, in accordance with the attached design permit /architectural and planning assignment/.
  3. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  4. The organization and responsibility for the execution of the decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff and the Head of the Nor Nork administrative district.
  5. Control over the implementation of this decision shall be ensured by the Secretary of the Yerevan City Hall Staff.
