ON CHANGING THE TARGET AND FUNCTIONAL DESIGNATIONS OF THE LAND PLOT AT 21 N. CHARBAKHI STREET, SHENGAVIT, YEREVAN

The basis for the adoption of the administrative act was the application of Samvel Khorshikyan's authorized representative Harutyun Harutyunyan regarding the change of the target and functional designations of the land plot with cadastral code 01-011-0245-0069, located at 21 N. Charbakhi Street, Shengavit, Yerevan, owned by Samvel Khorshikyan by right of ownership, as well as the state registration certificate of rights to real estate No. 31052024-01-0319, according to which the target designation of the land plot is agricultural, and the functional designation or land type is grapes.

The basis for discussing the issue were the state registration certificate of rights to real estate No. 31052024-01-0319 dated May 31, 2024, the letters of "High-Voltage Electric Networks" CJSC No. h./22 .3/794-2026 dated February 28, 2026, "Electric Networks of Armenia" CJSC No. DG-1676 dated February 24, 2026, "Veolia Jur" CJSC No. MSH/3444 dated February 10, 2026, "Gazprom Armenia" CJSC No. 53/53.13/878-2026 dated February 11, 2026, "Telecom Armenia" CJSC No. 345/26-1 dated February 16, 2026.

According to the general plan of Yerevan city approved by the decision No. 204-N of the Yerevan City Council of the Republic of Armenia dated September 10, 2024, the land plot is located in the zone of other lands of settlements.

The land plot under consideration is not included in the list of restrictions of Article 60 of the Land Code of the Republic of Armenia. According to the annexes approved by the decision No. 1023-N of the Government of the Republic of Armenia dated June 4, 2020, according to the agreed spatial assessment scheme, the land plot is located in zone 11.

Guided by Article 49 of the Law "On Local Self-Government in Yerevan City", Articles 7 (paragraphs 4 and 5) and 10 (paragraphs 1 and 2) of the Land Code, Article 3 of the Law "On the Fundamentals of Administration and Administrative Proceedings",

in accordance with Articles 53, 59 and 60, Article 14.3, Part 12 of the Law "On Urban Development", based on Decision No. 204-N of the Yerevan City Council of September 10, 2024, taking into account the conclusion of the Architecture and Urban Development Department of the Yerevan City Hall Staff:

  1. In accordance with the conventional signs enshrined in the Master Plan of Yerevan City approved by Decision No. 204-N of the Yerevan City Council of September 10, 2024, to define the targeted purpose of the land plot with cadastral code 01-011-0245-0069, with an area of 0.1 ha, located at 21 N. Charbakh Street, Shengavit, Yerevan, owned by Samvel Bardegmosi Khorshikyan, as residential areas, and the functional purpose, in accordance with Sub-point 3 of Point 24 of the procedure approved by Decision No. 1920-N of the Government of the Republic of Armenia of December 29, 2011 (purpose of use), as public development.

  2. The rights to the land plot with the changed targeted and functional purpose are subject to state registration in the Cadastre Committee of the Republic of Armenia, in accordance with the attached design permit (architectural and planning assignment).

  3. Take into account that the state registration of the right to change the targeted and functional purposes of the land plot on the basis of this decision is subject to implementation if the amount of the difference in the cadastral value approximated to the market value of the land plot at that time has been paid by the owner.

  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.

  5. The organization and responsibility for the implementation of the decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff and the Head of the Shengavit administrative district.

  6. Control over the implementation of this decision shall be ensured by the Secretary of the Yerevan City Hall Staff.
