On alienating a land plot to "Center for Rights of Families of Victims of Wars" NGO through direct sale

To alienate (sell) to "Center for Rights of Families of Victims of Wars" NGO through direct sale the land plot located at Sebastia Street, bldg. 157/6, with an area of 443.5 sq.m., at the established cadastral value. The Head of the Real Estate Management Department of the Yerevan City Hall Staff was instructed to conclude a land plot sale and purchase agreement with the organization after submitting the document confirming the payment. It was established that in case of non-payment of the cadastral value of the land plot within 15 days, the decision will be considered null and void. All expenses for state registration of property rights, notarization of the agreement, and obtaining a certificate will be covered by the NGO. The organization and responsibility for the execution of the decision were assigned to the heads of the relevant departments, and supervision to the staff secretary.

ON ALIENATING A LAND PLOT TO THE "CENTER FOR THE RIGHTS OF FAMILIES OF VICTIMS OF WARS" PUBLIC ORGANIZATION THROUGH DIRECT SALE

The basis for the adoption of the administrative act was the application of Tigran Martirosyan, legal representative of the "Center for the Rights of Families of Victims of Wars" NGO, on alienating the land plot located at 157/6 Sebastia Street to the public organization through direct sale.

The basis for discussing the issue was state registration certificate No. 07042025-01-0012 for rights to immovable property.

Hovhannes Zakaryan, a land user included in the list approved by Yerevan Mayor's Decision No. 3984-A of October 5, 2007, applied to the "Center for the Rights of Families of Victims of Wars" NGO with a request to alienate the said land plot to him by gratuitous right of ownership after the organization pays the cadastral value approximated to the market value of the land plot located at 157/6 Sebastia Street, allocated to the organization.

Based on Yerevan Mayor's Decision No. 3166-A of August 28, 2007, the 1.43 ha land plot located at 8/1 Kurghinyan Street, provided to the "Center for the Rights of Families of Victims of Wars" public organization by gratuitous /permanent/ right of use, was divided into separate property units based on the division plan provided by the company, and the land plots were assigned corresponding addresses.

The land plot under consideration is not included in the land plot defined by Article 60 of the Land Code, and according to the agreed spatial-assessment scheme of the annexes approved by Decision No. 1023-N of the Government of the Republic of Armenia of June 4, 2020, the land plot under consideration is located in the 7th zone and was transferred to the Yerevan community by Decision No. 1517-N of the Republic of Armenia of December 24, 2009. The code of the land plot is 01-007-515-001 (the code is included in Yerevan Council of Elders Decision No. 470-N of 26.06.2012, line 48612).

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Proceedings", the Law "On Establishing the Procedure for Cadastral Valuation Approximated to the Market Value of Real Estate for the Purpose of Taxation with Real Estate Tax", Decision No. 1023-N of the Government of the Republic of Armenia dated June 4, 2020, points 4 and 5 of Article 7, Article 59 and sub-point 3 of point 1 of Article 66 of the Land Code, point 55 of the Appendix to Decision No. 463-N of the Council of Elders of the City of Yerevan dated December 23, 2025, taking into account Decisions No. 1475-A of the Mayor of Yerevan dated July 11, 2005, No. 132-A dated February 1, 2006, No. 3984-A dated October 5, 2007, and No. 1456-A dated March 31, 2008, and Conclusions D-129298-25 and D-65901-26 of the Architecture and Urban Development Department of the Yerevan City Hall Staff:

  1. To alienate (sell) the land plot with an area of 443.5 sq.m. located at Sebasatia Street, No. 157/6, by direct sale by right of ownership, to the "Center for the Rights of Families Affected by Wars" NGO, at the cadastral value approximated to the market value of the 7th zone of valuation in force at the time of adoption of this decision (the value of 1 sq.m. is 24889 AMD), by paying 443.5 x 24889 = 11,038,271 AMD to account No. 900015211320 of the Yerevan City Hall (income from land alienation) for the land plot with an area of 443.5 sq.m.

  2. To instruct the Head of the Real Estate Management Department of the Yerevan City Hall Staff, after the "Center for the Rights of Families Affected by Wars" NGO submits a document confirming the payment of the cadastral values approximated to the market value of the land plot, to conclude a land purchase and sale agreement with the organization on behalf of the Mayor of Yerevan within five working days.

  3. To establish that in case the cadastral value approximated to the market value of the land plot is not paid by the acquirer of the land plot within a 15-day period from the date of adoption of this decision, point 1 of the decision shall be considered null and void.

  4. To take note that all expenses for the state registration of property rights arising from this decision, notarization of the contract, as well as obtaining a unified certificate provided by law, and other necessary payments are carried out at the expense of the "Center for the Rights of Families Affected by Wars" NGO.

  5. To take note that the purchase and sale agreement is subject to notarization, and the rights arising from the agreement are subject to state registration at the Cadastre Committee of the Republic of Armenia.

  6. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.

  7. To assign the organization and responsibility for the execution of the decision to the heads of the Architecture and Urban Development, and Real Estate Management Departments of the Yerevan City Hall Staff.

  8. Control over the implementation of this decision shall be ensured by the Secretary of the Staff of Yerevan City Hall. Tigran Avinyan
