Decision on setting the functional designation of the basement at 17 M. Khorenatsi St., building 27/2 as residential

This decision changes the functional designation of a basement at 17 M. Khorenatsi St., building 27/2, from its current use to residential, to be included in the residential fund as an apartment. The head of the Central Administrative District is instructed to register it accordingly. The change requires state registration with the Cadastre Committee. The decision enters into force the day after receipt and can be appealed within two months. Execution and oversight responsibilities are assigned to relevant municipal departments and the Secretary of the Yerevan Municipality Staff.

ON DEFINING THE FUNCTIONAL PURPOSE OF THE ATTIC AT BLDG. 17, APT. 27/2, M. KHORENATSI STREET, AS RESIDENTIAL

The basis for the adoption of the administrative act was the application of Vigen Zhulfayan regarding defining the functional purpose of the attic at Bldg. 17, Apt. 27/2, M. Khorenatsi Street, as residential and including it in the residential fund.
The basis for discussing the issue was the certificate of state registration of rights to real estate No. 13092024-01-0125 dated 13.09.2024, the consent of the co-owner of the 0.5 sq.m. area, which is common shared property at Bldg. 17, Apt. 27/2, M. Khorenatsi Street.
Guided by Article 49 of the Law "On Local Self-Government in Yerevan", Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Procedure", points 7 of Appendix 1 to Decision No. 88 of February 2, 2002, and points 1 and 5 of Appendix 1 to Decision No. 600-N of April 15, 2021, of the Government of the Republic of Armenia, taking into account the conclusion No. N/31914-26 dated 18.05.2026 of the Department of Architecture and Urban Development of the Yerevan Municipality Staff:

  1. To define the functional purpose of the attic located at Bldg. 17, Apt. 27/2, M. Khorenatsi Street, owned by Vigen Zhulfayan by right of ownership, as residential and include it in the residential fund as an apartment (provided that it does not contradict the requirements of "HHSN 31-01-2014").

  2. To instruct the head of the Kentron administrative district to register the attic mentioned in point 1 of this decision as an apartment.

  3. To take into account that the change in the functional purpose of the area defined by this decision is subject to state registration in the Cadastre Committee of the Republic of Armenia.

  4. This decision enters into force on the day following its receipt.

  5. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.

  6. To assign the organization and responsibility for the execution of the decision to the heads of the Real Estate Management, Architecture and Urban Development Departments of the Yerevan Municipality Staff and the head of the Kentron administrative district.

  7. Control over the implementation of this decision shall be ensured by the Secretary of the Yerevan Municipality Staff.
