This decision legalizes the public building with a total area of 720.1 sq.m, voluntarily constructed on the land plot belonging to Roza Hrachayi Arakelyan by right of ownership, located at the address A. Sargsyan street, h.14, Ajapnyak administrative district of Yerevan. The decision also establishes the functional designation of the land plot as public construction. A payment of 5,430,995 AMD is set for the legalization of the self-built structure, which must be made within 60 days.

ON LEGALIZING A STRUCTURE SELF-BUILT BY CITIZEN ROZA
HRACHI ARAKELYAN ON LAND OWNED BY HER AND ON DEFINING
THE FUNCTIONAL PURPOSE OF THE LAND
Guided by the Law "On Defining the Procedure for Cadastral Valuation
Approximated to the Market Value of Real Estate for the Purpose of Real Estate
Taxation", by point 17 of the procedure approved by Decision No. 912-N of the
Government of the Republic of Armenia of May 18, 2006, based on Decision No.
5299-A of the Mayor of Yerevan of November 12, 2010, the professional opinion
issued on 21.08.2026 by the Department of Architecture and Urban Development of
the Yerevan City Hall Staff regarding the compliance of the structure with the
legalization conditions defined by part 5 of Article 188 of the Civil Code,
taking into account the positive technical opinion issued by "HOVARS SHIN" LLC
on 22.05.2024, the opinion issued by "B-61" LLC on 20.07.2026 regarding the
external dimensions of self-built structures, as well as the applications of the
person who carried out the construction, represented by a proxy (10.10.2023 No.
D-124350-23, 17.06.2024 No. D-76918-24, 01.11.2024 No. D-139313-24, 16.04.2026 No.
D-38721-26, 23.07.2026 No. D-77316-26):

  1. Based on sub-point 3 of point 24 of the procedure approved by Decision No.
    1920-N of the Government of the Republic of Armenia of December 29, 2011, to
    define the functional purpose (purpose of use) of the land plot with an area of
    196.7 square meters occupied by the real estate located at Yerevan, Ajapnyak
    administrative district, A. Sargsyan street, bldg. 14, as public development.
  2. To legalize the structure with an area of 720.1 square meters self-built
    by Roza Hrachii Arakelyan on the land plot owned by her (state registration
    certificate of rights to real estate No. 17012018-01-0027, registration code No.
    2022DFU2L7 in the RA Cadastre Committee) at Yerevan, Ajapnyak, A. Sargsyan
    street, bldg. 14.

square meters of total area (public building), to be recognized as legal.
3. Take into consideration that:

  1. the preservation of the structure does not violate the rights and legally protected interests of other persons or pose a threat to the life and health of citizens.
  2. the building is not constructed in the alienation or safety zones of engineering and transport objects, or is not constructed with significant violations of urban planning norms and rules and does not create the right to demand compulsory servitude.
  1. Stipulate that the owner of the land plot:
  1. within 60 days from the date of adoption of this decision, must pay to the Yerevan city budget account N900015211247 the legalization fee of 5430995 (five million four hundred thirty thousand nine hundred ninety-five) Republic of Armenia drams calculated by the decision of the Government of the Republic of Armenia N912-N of May 18, 2006.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of failure to make the payment established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the execution of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  4. Control over the execution of the decision shall be assigned to the Secretary of the Yerevan City Hall Staff.
