ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT OWNED BY CITIZEN GEVORG AZATI AGHAJANYAN BY RIGHT OF OWNERSHIP AT THE ADDRESS YEREVAN, KENTRON, S. ZAVARYAN STREET H.97

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", points 8.1 and 17 of the procedure approved by the decision of the Government of the Republic of Armenia dated May 18, 2006, h.912-N, taking as a basis the decision of the Mayor of Yerevan dated November 12, 2010, h.5299-A, the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan Municipality Staff on 02.06.2026 regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, taking into account the certificate h.AT-16032026-01-0511 issued by the RA Cadastre Committee on 16/03/2026 regarding the registration of the unauthorized construction, the positive technical conclusion issued by "SHEMQ" LLC on 02.09.2025, the conclusion issued by "VIJI-S" LLC on 15.04.2026 regarding the external dimensions of the unauthorized constructions, as well as the applications of the person who carried out the construction and the representative (02.05.2025 h.D-46874-25, 04.09.2025 h.D-97589-25, 18.03.2026 h.D-26387-26, 15.04.2026 h.D-38024-26):

  1. To recognize as legal the construction with a total area of 418.3 sq. meters (public building), the unauthorized opened windows - 5 (five) units, the unauthorized opened doors - 2 (two) units, located on the land plot owned by citizen Gevorg Azati Aghajanyan by right of ownership (state registration certificate of rights to real estate h.19052026-01-0089) at the address Yerevan, Kentron, S. Zavaryan street h.97.
  2. To take note that:
    1. the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.
  1. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.
  1. Establish that the owner of the land plot:
  1. within 60 days from the date of adoption of this decision, shall pay to the account N900015211247 of the Yerevan city budget the legalization fee of 5180548 (five million one hundred eighty thousand five hundred forty-eight) Republic of Armenia drams calculated by the decision H.912-N of May 18, 2006, of the Government of the Republic of Armenia.
  2. shall pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.
  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality.
  4. Control over the implementation of the decision shall be assigned to the Secretary of the Staff of the Yerevan Municipality.
