This decision legalizes the residential building with a surface area of 79.8 sq. meters, built by Arshak Vachagan Aghajanyan and Gayane Minasi Minasyan at the address No. 2/56, Block G-1, Ajapnyak administrative district of Yerevan. The functional designation of the land plot is also established as residential development. The decision obliges the owners to pay the legalization fee and the fees and duties related to the state registration of property rights within a 60-day period.

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax", by points 10 and 11 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, based on the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued by the Architecture and Urban Development Department of the Yerevan City Hall staff on 30.07.2026 regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, taking into account the positive technical conclusion issued by "HABSHIN NAKHAGITS" LLC on 15.09.2022, the conclusion issued by "Melkar" LLC on 01.09.2022 regarding the external dimensions of self-initiated constructions, the certificate issued on 07.12.2022, as well as the applications of the person who carried out the construction, in the person of the representative (07.10.2022 D-87592-22, 08.12.2022 D-117966-22, 20.04.2026 D-40304-26, 06.05.2026 D-45343-26, 07.07.2026 D-70575-26).

  1. Based on sub-point 3 of point 24 of the procedure approved by the decision of the Government of the Republic of Armenia No. 1920-N of December 29, 2011, to define the functional designation (purpose of use) of the land plot with an area of 126.8 square meters occupied by the real estate located at H.2/56, G-1 district, Ajapnyak administrative district, Yerevan, as residential construction.

  2. To recognize as legal the construction (residential buildings) with a total area of 79.8 square meters self-initiated by citizens Arshak Vachagani Aghajanyan and Gayane Minasi Minasyan on the land plots at Yerevan, Ajapnyak, G-1 district, H.2/56 address, which are general joint ownership, general shared ownership (state registration certificate of rights to real estate No. 27102016-01-0092, registration code No. 202299CELE in the Cadastre Committee of the Republic of Armenia).

  3. Take into consideration that:

  1. the preservation of the structure does not violate the rights and interests protected by law of other persons or endanger the life and health of citizens.
  2. the building is not constructed in the alienation or safety zones of engineering and transport objects, or is not constructed with significant violations of urban planning norms and rules and does not create the right to demand compulsory servitude.
  1. Establish that the landowners:
  1. within 60 days from the date of adoption of this decision, must pay to the Yerevan city budget account N900015211247 the legalization fee of 300926 (three hundred thousand nine hundred twenty-six) Republic of Armenia drams calculated by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006.
  2. must pay the fees and duties related to the state registration of property rights of the structure at their own expense.
  3. in case of non-payment of the legalization fee provided for by sub-point 1 of this point within 60 days from the date of adoption of this decision, this decision is considered null and void.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff.
  4. Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan City Hall Staff.
