YEREVAN, KENTRON, ARAM STREET H.88/1 ADDRESS, REGARDING THE LEGALIZATION OF AN UNAUTHORIZED CONSTRUCTION MADE BY CITIZENS YERVAND ROBERTI MINASYAN AND DIANA GASPARI SARAFYAN
Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax", by point 28 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, based on the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan City Hall staff on 31.07.2026 regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, taking into account the positive technical conclusion No. 26-563 issued by "ARTAGERATATESCHAKAN PORDZAQNNUTYUN" CJSC on 30.06.2026, the written consents given by the co-owners, the conclusion issued by "ARMEN DAVTYAN" IE on 22.06.2026, as well as taking into account the application of the persons who carried out the construction (20.07.2026 No. D-75606-26).

  1. To recognize as legal the construction with a total area of 30.5 square meters (public /27.1 square meters - open balcony, 3.4 square meters - staircase/) carried out unauthorizedly by citizens Yervand Roberti Minasyan and Diana Gaspari Sarafyan at Yerevan, Kentron, Aram street h.88/1 (state registration certificate of rights to real estate No. 28112024-01-0006, registration code in the Cadastre Committee of the Republic of Armenia No. 2026YGJLF9).
  2. To take into account that:
  1. the preservation of the construction does not violate the rights and interests protected by law of other persons or threaten the life and health of citizens.
  2. the construction was not built with significant violations of urban planning norms and rules and does not create the right to demand compulsory servitude.
  1. To establish that the person who carried out the construction.
  1. within 60 days from the date of adoption of this decision, pay to account N900015211247 of the Yerevan city budget the legalization fee of 518,500 (five hundred eighteen thousand five hundred) Republic of Armenia drams calculated by the Republic of Armenia Government Decision No. 912-N of May 18, 2006.
  2. pay fees and duties related to the state registration of property rights of the structure at their own expense.
  3. in case of failure to make the payment established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall staff.
  4. Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan City Hall staff.
