On the legalization of an unauthorized structure

ON LEGALIZATION OF AN UNAUTHORIZED CONSTRUCTION

Considering that the preservation of the unauthorized construction located on the land plot owned by the city of Yerevan, at Arin-Berd Street, 2nd Lane, No. 37, does not violate the rights and legally protected interests of other persons, does not pose a threat to the life and health of citizens, taking into account that the unauthorized construction is not built on land plots provided for by Article 60 of the Land Code, in the alienation and safety zones of engineering and transport facilities and with significant violations of urban planning norms and rules, does not create the right to demand compulsory servitude, as well as based on the fact that the unauthorized construction is not located in the approved zones provided for by state or community urban planning complex programs, guided by the Law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax", Articles 188, parts 2 and 5 of the Civil Code, point 2 of the procedure approved by the Government of the Republic of Armenia Decision N731-N of May 18, 2006, point 33 of the procedure approved by the Government of the Republic of Armenia Decision N912-N of May 18, 2006, as well as taking into account the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan Municipality Staff on 06.02.2026, the positive technical conclusion No. E39-25 issued by "SEISMIC SAFETY" LLC on 03.03.2025, the applications of the person who carried out the construction (23.08.2022 No. D-66723-22, 10.08.2023 No. D-98185-23, 21.11.2023 No. D-145073-23, 15.02.2024 No. D-21192-24, 04.03.2025 No. D-23298-25, 01.10.2025 No. D-108164-25):

  1. The unauthorized construction (residential building, functional purpose) built on the land plot with a total area of 137.59 sq.m. located at Arin-Berd Street, 2nd Lane, No. 37, Yerevan, which is the property of the city of Yerevan (code for entering measurement data issued by the Cadastre Committee of the Republic of Armenia No. 2022994ZMG), shall be considered the property of the city of Yerevan and recognized as legal (the plans of the land plot and buildings are attached).

  2. Based on the provisions of the Yerevan City Master Plan approved by decision No. 204-N of 10.09.2024 of the Yerevan City Council of the Republic of Armenia, define the functional purpose of the land plot with an area of 137.59 sq.m. mentioned in point 1 of this decision as residential development.

  3. Make an offer to the person who carried out the construction, Vardouhi Noriki Harutyunyan, hereinafter referred to as the Buyer, to acquire the legalized structure and land plot mentioned in point 1 of this decision through direct sale with the right of pre-emption.

  4. Authorize the Head of the Architecture and Urban Development Department of the Yerevan Municipality Staff, after receiving a written certificate-extract provided by the Financial Department of the Staff confirming the payment of the amounts for the legalization of the structure mentioned in point 1 of this decision and the land plot allocated for it, in the established amount and procedure, by the person who carried out the unauthorized construction, and the fact that it has been credited to the corresponding account of the Yerevan community budget, to conclude a real estate purchase and sale agreement with the Buyer on behalf of the Mayor of Yerevan within a 30-day period.

  5. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.

  6. Place the control over the execution of the decision on the Secretary of the Yerevan Municipality Staff.
