DECISION OF THE MAYOR OF YEREVAN

ON LEGALIZATION OF AN UNAUTHORIZED CONSTRUCTION

Based on the decision of the RA Administrative Court No. VD/3397/05/23 of 07.06.2024 in administrative cases, guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", taking into account the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan Municipality Staff on 31.07.2026:

  1. The unauthorized construction (registration code No. 2022QCU5BP in the Cadastre Committee of the Republic of Armenia) with a public building functional purpose, built on a land plot with a total area of 42.6 sq.m. located at Bagratunyats street, 2nd lane, h.23/1, shall be considered the property of Yerevan city and recognized as legal (land plot and building plans are attached).

  2. An offer to acquire the legalized construction and land plot mentioned in point 1 of this decision by direct sale with the right of pre-emption shall be made to the person who carried out the construction, Taron Artashi Tonoyan, hereinafter referred to as the Buyer.

  3. Based on the provisions of the General Plan of Yerevan city approved by the decision No. 204-N of 10.09.2024 of the Council of Elders of Yerevan city, RA, the functional purpose of the land plot with an area of 42.6 sq.m. mentioned in point 1 of this decision shall be set as public development.

  4. Authorize the head of the Department of Architecture and Urban Development of the Yerevan Municipality Staff to conclude a real estate purchase and sale agreement on behalf of the Mayor of Yerevan with the Buyer within 30 days after receiving a written certificate-extract provided by the financial department of the staff, confirming the payment of the amounts for the legalization of the construction mentioned in point 1 of this decision and the land plot allocated for it, in the established amount and procedure, and the fact of their crediting to the corresponding account of the Yerevan community budget.

  5. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia, within a two-month period from the date of its entry into force. 6. Control over the execution of the decision shall be assigned to the Secretary of the Staff of the Yerevan Municipality.
