ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT
OWNED BY CITIZEN HAYKAZ ASHOTI HARUTYUNYAN BY RIGHT OF OWNERSHIP
AT YEREVAN, SHENGAVIT, NORAGAVIT 12TH STREET, BLDG. 51

Guided by the Law "On establishing the procedure for cadastral valuation of real estate
approximated to market value for the purpose of real estate tax assessment", points 10 and 11
of the procedure approved by the Government of the Republic of Armenia's decision No. 912-N
of May 18, 2006, based on Yerevan Mayor's decision No. 5299-A of November 12, 2010,
the professional conclusion issued by the Architecture and Urban Development Department of
Yerevan Municipality Staff on 29.07.2026 regarding the compliance of the construction with the
legalization conditions defined by Article 188, Part 5 of the Civil Code, the positive technical
conclusion issued by "HABSHIN PROJECT" LLC on 13.04.2026, taking into account the
conclusion issued by "HAYK AVAGYAN ALEKSANI" IE on 22.04.2026 regarding the external
dimensions of unauthorized constructions, as well as the applications of Haykaz Harutyunyan,
the person who carried out the construction, represented by his representative (22.04.2026 No. D-41254-26, 29.05.2026 No. D-55305-26):

  1. To recognize as legal the unauthorized construction with a total area of 621.67 square meters
    (residential buildings) located on the land plot owned by citizen Haykaz Ashoti Harutyunyan
    by right of ownership (state registration certificate of rights to real estate No. 29122023-01-0482
    of 29.12.2023, cadastral registration code No. 2026LB5ZDF of the Cadastre Committee of the RA)
    at Yerevan, Shengavit, Noragavit 12th Street, Bldg. 51.
  2. To take note that:
  1. the preservation of the construction does not violate the rights and legally protected interests
    of other persons or threaten the life and health of citizens;

  2. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

  1. Establish that the owner of the land plot:
  1. within 60 days from the date of adoption of this decision, must pay to the Yerevan city budget account N900015211247 the legalization fee of 1993074 (one million nine hundred ninety-three thousand seventy-four) Armenian Dram calculated by the decision of the Government of the Republic of Armenia N912-N of May 18, 2006.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the established fee for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality.
  4. Control over the implementation of the decision shall be assigned to the Secretary of the Staff of the Yerevan Municipality.
