ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT BELONGING TO CITIZEN JIVAN RAFIKI GALUSTYAN BY RIGHT OF OWNERSHIP AT YEREVAN, SHENGAVIT, GHARIBJANYAN STREET H.111

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", by points 8.1, 10 and 11 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, based on the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued on 30.07.2026 by the Department of Architecture and Urban Development of the Yerevan Municipality Staff regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the positive technical conclusion issued on 25.06.2025 by "URBAN DESIGN" LLC, taking into account the reference issued on 09.03.2023 by "NAKHAGITSRIELT" LLC regarding the external dimensions of unauthorized constructions, as well as taking into account the applications of the person who carried out the construction (16.07.2024 No. D-90847-24, 03.07.2025 No. D-71305-25, 25.09.2025 No. D-105967-25, 03.04.2026 No. D-33015-26, 02.06.2026 No. D-56324-26).

To recognize as legal the construction with a total area of 324.3 square meters (residential house), 1 (one) unauthorized opened door and 1 (one) unauthorized opened window, located on the land plot belonging to citizen Jivan Rafiki Galustyan by right of ownership (state registration certificate of rights to real estate No. 05032025-01-0174 of 02.08.2019) at Yerevan, Shengavit, Gharibjanyan street h.111.
To take note that:

the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.))
the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude. 3. Establish that the owner of the land plot: 1) within 60 days from the date of adoption of this decision, must pay to account N900015211247 of the Yerevan city budget the legalization fee of 1447794 (one million four hundred forty-seven thousand seven hundred ninety-four) Armenian drams calculated by Decision No. 912-N of the Government of the Republic of Armenia dated May 18, 2006; 2) must pay the fees and duties related to the state registration of property rights of the structure at his own expense; 3) in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void. 4. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia. 5. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force. 6. The organization and responsibility for the execution of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality. 7.
