REGARDING THE LEGALIZATION OF AN UNAUTHORIZED STRUCTURE LOCATED ON A PARCEL OF LAND BELONGING TO CITIZEN ARMEN SERYANI ZAKHARYAN BY RIGHT OF OWNERSHIP AT THE ADDRESS YEREVAN, NOR NORK, MOLDOVAKAN STREET, H.35/20

Guided by the Law "On defining the procedure for cadastral assessment approximated to the market value of real estate for the purpose of real estate taxation",
by points 10 and 11 of the procedure approved by the Decision of the Government of the Republic of Armenia dated May 18, 2006, h.912-N, based on the Decision of the Mayor of Yerevan dated November 12, 2010, h.5299-A, the professional conclusion given on 29.07.2026 by the Department of Architecture and Urban Development of the staff of the Yerevan Municipality regarding the compliance of the structure with the legalization conditions defined by part 5 of Article 188 of the Civil Code, taking into account the positive technical conclusion h.507/26 given on 30.06.2026 by "A.R.M.SHIN" LLC, the conclusion on the external dimensions of unauthorized structures given on 24.06.2026 by "Rustam Matevosyan" PE, as well as taking into account the applications of the person who implemented the structure, represented by a representative (02.07.2026 h.D-68879-26, 17.07.2026 h.D-74868-26).

  1. To recognize as legal the structure (residential buildings) with a total area of 638.95 square meters implemented unauthorizedly on the parcel of land belonging to citizen Armen Seryani Zakharyan by right of ownership (certificate of state registration of rights to real estate h.23062026-01-0250, registration code in the RA Cadastre Committee h.2026NKNAKG) at the address Yerevan, Nor Nork, Moldovakan street, h.35/20.

  2. To take note that:

  1. the maintenance of the structure does not violate the rights and legally protected interests of other persons or does not pose a threat to the life and health of citizens;

  2. the building is not constructed in the alienation or safety zones of engineering-transportation objects, or is not constructed in violation of urban planning norms and

significant violations of norms and does not give rise to the right to demand a compulsory servitude.
3. Establish that the person who carried out the construction:

  1. within a 60-day period from the date of adoption of this decision, shall pay the legalization fee of 2409481 (two million four hundred nine thousand four hundred eighty-one) Republic of Armenia drams, calculated by the Republic of Armenia Government Decision No. 912-N of May 18, 2006, to the Yerevan city budget account No. 900015211247.
  2. shall pay the fees and duties related to the state registration of property rights of the structure at their own expense.
  3. in case of failure to make the payment established for legalization within a 60-day period from the date of adoption of this decision, this decision shall be considered void.
  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.
  2. This decision may be appealed through administrative procedure to the Mayor of Yerevan or through judicial procedure to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the staff of the Yerevan Municipality.
  4. The supervision over the implementation of the decision shall be assigned to the Secretary of the staff of the Yerevan Municipality.
