ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT OWNED BY GAYANE VARDANI MURADYAN BY RIGHT OF JOINT COMMON OWNERSHIP AT YEREVAN, MALATIA-SEBASTIA, P. TICHINA STREET H.45/1, AND DEFINING THE FUNCTIONAL SIGNIFICANCE OF THE CONSTRUCTION

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", points 8.1, 10, 11, and 17 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, taking as a basis the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued by the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality on 31.07.2025 regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the positive technical conclusion issued by "HABSHIN NAKHAGITS" LLC on 18.02.2025, taking into account the conclusions issued by "Aram Ajabkhanyan" IE on 26.03.2023 and 26.12.2023 regarding the external dimensions of unauthorized constructions, the written consent given by the joint common owner, as well as taking into account the applications of the person who carried out the construction, in the person of the representative (29.03.2023 No. D-37409-23, 11.05.2023 No. D-55580-23, 28.11.2023 No. D-148268-23, 28.12.2023 No. D-163781-23, 10.10.2024 No. D-129650-24, 20.02.2025 No. D-19197-25, 08.04.2025 No. D-37448-25, 02.07.2025 No. D-70993-25, 25.12.2025 No. D-144131-25, 29.01.2026 No. D-7864-26, 16.04.2026 No. D-38686-26).

  1. Taking as a basis point 7 of Annex 1 to Decision No. 88 of the Government of the Republic of Armenia of February 2, 2002, to define the areas with surfaces of 38.1 sq.m., 10.7 sq.m., 7.8 sq.m. located at Yerevan, Malatia-Sebastia, P. Tichina Street h.45/1 as public without architectural and planning assignment and design changes, and to include them in the non-residential fund, provided that they do not contradict the requirements of "HHSN 30-01-2014".

  2. To instruct the head of the Malatia-Sebastia administrative district of Yerevan to register the areas with surfaces of 38.1 sq.m., 10.7 sq.m., 7.8 sq.m. located at Yerevan, Malatia-Sebastia administrative district, P. Tichina Street h.45/1 as public purpose.

  3. To recognize as legal the structure with a total area of 43.6 square meters, residential/garage, and 2 (two) self-opened doors, self-executed on the land plot belonging to citizen Gayane Vardani Muradyan at 45/1 P. Tichina Street, Malatia-Sebastia, Yerevan, under the right of common joint ownership (state registration certificate of rights to immovable property No. 30112022-01-0239).

  4. To take into account that:

  1. the preservation of the structure does not violate the rights and legally protected interests of other persons or pose a danger to the life and health of citizens.
  2. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not create the right to demand compulsory servitude.
  1. To establish that the owner of the land plot:
  1. within 60 days from the date of adoption of this decision, must pay to the Yerevan city budget account No. 900015211247 the legalization fee of 202327 (two hundred two thousand three hundred twenty-seven) Armenian drams calculated by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void.
  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. To assign the organization and responsibility for the execution of this decision to the head of the Architecture and Urban Development Department of the Yerevan Municipality Staff.
  4. To assign the control over the execution of the decision to the Secretary of the Yerevan Municipality Staff.
