ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND OWNED BY "ROBERT-TARON" LIMITED LIABILITY COMPANY AT YEREVAN, AVAN, MARSHAL BABAJANYAN STREET H.1/1

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax", point 17 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, based on the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan Municipality staff on 17.08.2026, taking into account the letter No. GM/13987-2026 issued by the Deputy Head of the RA Cadastre Committee on 06.07.2026 regarding the registration of the unauthorized construction, the technical positive conclusion No. 26-667 issued by "INTERDEPARTMENTAL EXPERTISE" CJSC on 31.07.2026, the conclusion issued by "LEPIDUS" LLC on 22.05.2026 regarding the external dimensions of unauthorized constructions, as well as the application of "ROBERT-TARON" LLC, represented by director Yeghishe Avagyan (06.08.2026 No. D-83016-26).

  1. To recognize as legal the construction (production /cover/) with a total area of 143.08 square meters, unauthorizedly carried out on the land owned by "ROBERT-TARON" limited liability company (registration number: 282.110.03656 issued on 21.07.1999) at Yerevan, Avan, Marshal Babajanyan street h.1/1 (state registration certificate of rights to real estate No. 22062026-01-0035).

  2. Take note that:

  1. the preservation of the construction does not violate the rights and legally protected interests of other persons or pose a threat to the life and health of citizens.)))

  2. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

  1. Establish that the owner of the land plot:
  1. within 60 days from the date of adoption of this decision, must pay to the account N900015211247 of the Yerevan city budget the legalization fee of 952269 (nine hundred fifty-two thousand two hundred sixty-nine) Armenian drams calculated by the decision H.912-N of May 18, 2006, of the Government of the Republic of Armenia.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void.
  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the execution of this decision shall be assigned to the head of the Architecture and Urban Development Department of the Yerevan Municipality Staff.
  4. Control over the execution of the decision shall be assigned to the Secretary of the Yerevan Municipality Staff.
