ON LEGALIZING AN UNAUTHORIZED STRUCTURE LOCATED ON A LAND PLOT OWNED BY CITIZEN HAMLET AHARONI TADEVOSYAN BY RIGHT OF OWNERSHIP AT THE ADDRESS YEREVAN, MALATIA-SEBASTIA, S. OHANOV STREET H.9/9

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", points 8.1 and 17 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, taking as a basis the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan Municipality Staff on 18.08.2026 regarding the compliance of the structure with the legalization conditions defined by part 5 of Article 188 of the Civil Code, taking into account the positive technical conclusion issued by "HOVARS SHIN" LLC on 03.10.2022, the reference issued by "Margarit Nitalyan" IE on 14.07.2022 regarding the external dimensions of unauthorized structures, as well as taking into account the applications of the person who carried out the construction (15.07.2022 No. D-50291-22, 04.11.2022 No. D-101355-22, 13.09.2023 No. D-113912-23, 23.10.2023 No. D-130370-23, 13.05.2026 No. D-48239-26, 23.06.2026 No. D-64762-26):

  1. To recognize as legal the structure with a total area of 1162.2 square meters (production buildings), 5 (five) unauthorized windows, 1 (one) unauthorized door, illegally constructed on the land plot owned by citizen Hamlet Aharoni Tadevosyan by right of ownership (state registration certificate of rights to real estate No. 21012020-01-0257, registration code No. 2022DVXBPL in the Cadastre Committee of the Republic of Armenia) at the address Yerevan, Malatia-Sebastia, S. Ohanov street h.9/9.

  2. To take note that:

  1. the preservation of the structure does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.

  2. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

  1. Establish that the person who carried out the construction:
  1. within 60 days from the date of adoption of this decision, must pay to the account N900015211247 of the Yerevan city budget the legalization fee of 7761645 (seven million seven hundred sixty-one thousand six hundred forty-five) Armenian drams calculated by the decision of the Government of the Republic of Armenia N912-N of May 18, 2006.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void.
  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the head of the Architecture and Urban Development Department of the Yerevan Municipality Staff.
  4. Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan Municipality Staff.
