On legalizing an arbitrarily constructed building

The decision of the Mayor of Yerevan concerns the legalization of an arbitrarily constructed building with an area of 186.3 square meters belonging to citizen Edgar Alberti Saribekyan on a land plot located in the Shengavit administrative district. ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT OWNED BY CITIZEN EDGAR ALBERTI SARIBEKYAN BY RIGHT OF OWNERSHIP AT YEREVAN, SHENGAVIT, "NOR UGHI" COLLECTIVE FARM NO. 1 LAND AREA NO. 24 LAND PLOT ADDRESS

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", points 10 and 11 of the procedure approved by the Government of the Republic of Armenia's decision No. 912-N of May 18, 2006, taking as a basis the Yerevan City Mayor's decision No. 5299-A of November 12, 2010, the professional conclusion issued by the Architecture and Urban Development Department of the Yerevan City Hall staff on 30.07.2026 regarding the compliance of the construction with the legalization conditions defined by Article 188, Part 5 of the Civil Code, the positive technical conclusion issued by "KHACHVAHAN" LLC on 28.02.2026, taking into account the certificate issued by "Arsen Melkonyan Arturi" IE on 06.04.2026 regarding the external dimensions of unauthorized constructions, as well as taking into account the application of the person who carried out the construction (05.06.2026 No. D-58123-26):

To recognize as legal the construction with a total area of 186.3 square meters (residential house: 169.3 square meters, auxiliary building: 13.8 square meters, fences: 3.2 square meters) carried out unauthorizedly on the land plot owned by citizen Edgar Alberti Saribekyan by right of ownership (real estate ownership (use) right registration certificate No. 1753799 of 11.03.2005, RA Cadastre Committee registration code No. 2026NNNJ6B) at Yerevan, Shengavit, "Nor Ughi" collective farm No. 1 land area No. 24 land plot address.
To take note that:

the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.
the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

Establish that the owner of the land plot:

within 60 days from the date of adoption of this decision, shall pay to the account N900015211247 of the Yerevan city budget the legalization fee of 597278 (five hundred ninety-seven thousand two hundred seventy-eight) Armenian drams calculated by the decision of the Government of the Republic of Armenia N912-N of May 18, 2006.
shall pay the fees and duties related to the state registration of property rights of the structure at his own expense.
in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.

This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
The organization and responsibility for the execution of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality.
Control over the execution of the decision shall be assigned to the Secretary of the Staff of the Yerevan Municipality.
