ON LEGALIZING THE UNAUTHORIZED CONSTRUCTION CARRIED OUT BY CITIZENS GAGIK NORIKI HAYRAPETYAN AND GAYANE ROBERTI HAYRAPETYAN ON THE LAND PLOTS CONSTITUTING COMMON SHARED PROPERTY AT YEREVAN, SHENGAVIT, G. NJDEH STREET H.21

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax", points 8.1 and 17 of the procedure approved by the Government of the Republic of Armenia's decision No. 912-N of May 18, 2006, based on the Mayor of Yerevan's decision No. 5299-A of November 12, 2010, the professional conclusion issued on 04.08.2026 by the Department of Architecture and Urban Development of the Yerevan Municipality staff regarding the compliance of the construction with the legalization conditions defined by Article 188, Part 5 of the Civil Code, the positive technical conclusion issued on 25.02.2026 by "HABSHIN NAKHAGITS" LLC, taking into account the conclusion issued on 04.03.2026 by "MEGAGRID" LLC regarding the external dimensions of unauthorized constructions, as well as taking into account the applications of the persons who carried out the construction, represented by their representative (10.03.2026 No. D-23070-26, 01.04.2026 No. D-32031-26, 12.05.2026 No. D-47804-26):

  1. To recognize as legal the construction with a total area of 140.4 square meters (public (trade hall: 134.6 square meters, fence: 5.8 square meters)) and 3 (three) unauthorized opened doors carried out by citizens Gagik Noriki Hayrapetyan and Gayane Roberti Hayrapetyan on the land plot constituting common shared property (state registration certificate of rights to real estate No. 04062019-01-0243 issued on 04.06.2019) at Yerevan, Shengavit, G. Njdeh Street h.21.

  2. To take note that:

  1. the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.

  2. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

  1. Establish that the persons who carried out the construction:
  1. within 60 days from the date of adoption of this decision, must pay to the account N900015211247 of the Yerevan city budget the legalization fee of 1259221 (one million two hundred fifty-nine thousand two hundred twenty-one) AMD calculated by the decision H.912-N of May 18, 2006, of the Government of the Republic of Armenia.
  2. must pay the fees and duties related to the state registration of property rights of the building at their own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the execution of this decision shall be assigned to the head of the Architecture and Urban Development Department of the Yerevan Municipality Staff.
  4. Control over the execution of the decision shall be assigned to the Secretary of the Yerevan Municipality Staff.
