On legalizing an arbitrarily constructed building

ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT BELONGING TO CITIZEN GRISHA KAMOYI HOVSEPYAN BY RIGHT OF OWNERSHIP AT YEREVAN, SHENGAVIT, NERKIN CHARBAKHI 6TH STREET H.28

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", by points 10 and 11 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, taking as a basis the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued on 20.07.2026 by the Department of Architecture and Urban Development of the Yerevan Municipality Staff regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the positive technical conclusion issued on 25.03.2025 by "ARTAGERATATESCHAKAN PORKSAKNOOTYUN" CJSC, taking into account the reference issued on 31.07.2023 by "Gnel Arakelyan" IE regarding the external dimensions of the unauthorized constructions, as well as the applications of Grisha Hovsepyan, the person who carried out the construction, in the person of his representative (29.03.2024 No. D-41654-24, 26.03.2025 No. D-31907-25, 22.04.2025 No. D-42875-25, 03.02.2026 No. D-9253-26, 03.04.2026 No. D-32956-26).

  1. To recognize as legal the construction with a total area of 268.7 square meters (residential house: 161.2 square meters, basement: 32.6 square meters, staircase: 6.7 square meters, roof: 17.4 square meters, auxiliary building: 50.6 square meters, fence: 0.2 square meters) carried out unauthorizedly on the land plot belonging to citizen Grisha Kamoyi Hovsepyan by right of ownership (state registration certificate of rights to real estate No. 18012024-01-0236 of 18.01.2024, registration code of the Cadastre Committee of the Republic of Armenia No. 2026BWNBVN) at Yerevan, Shengavit, Nerkin Charbakhi 6th Street h.28.

  2. To take note that:

  1. the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.

DECISION OF THE MAYOR OF YEREVAN

  1. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.
  1. Establish that the owner of the land plot:

  1. within 60 days from the date of adoption of this decision, must pay to the account N900015211247 of the Yerevan city budget the legalization fee of 622310 (six hundred twenty-two thousand three hundred ten) Armenian drams calculated by the decision of the Government of the Republic of Armenia N912-N of May 18, 2006.

  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.

  3. in case of non-payment of the established fee for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void.

  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.

  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.

  3. The organization and responsibility for the execution of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality.

  4. Control over the execution of the decision shall be assigned to the Secretary of the Staff of the Yerevan Municipality.
