ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT OWNED BY CITIZEN ARTASHES ARSHALUYSI HAKOBYAN BY RIGHT OF OWNERSHIP AT YEREVAN, SHENGAVIT, N. SHENGAVIT 12TH STREET 1ST LANE H.11

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", points 10 and 11 of the procedure approved by the Government of the Republic of Armenia's decision No. 912-N of May 18, 2006, taking as a basis the decision No. 5299-A of the Mayor of Yerevan of November 12, 2010, the professional conclusion issued by the Architecture and Urban Development Department of the Yerevan Municipality Staff on 30.07.2026 regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the positive technical conclusion issued by "SEISMASHIN" LLC on 18.05.2026, taking into account the conclusion issued by "JIVAN HARUTYUNYAN ARSENI" IE on 06.05.2026 regarding the external dimensions of the unauthorized constructions, as well as the application of the person who carried out the construction, Artashes Hakobyan, represented by his representative (22.06.2026 No. D-64121-26):

To recognize as legal the construction with a total area of 224.4 square meters (residential house) carried out unauthorizedly on the land plot owned by citizen Artashes Arshaluysi Hakobyan by right of ownership (certificate of registration of real estate ownership (use) rights No. 2847518 of 17.08.2011, cadastral committee registration code No. 20263MUCFZ) at Yerevan, Shengavit, N. Shengavit 12th Street 1st Lane H.11.
Take note that:

the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.
the building is not constructed in the alienation or safety zones of engineering and transport objects, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

Establish that the owner of the land plot:

within 60 days from the date of adoption of this decision, must pay to the Yerevan city budget account N900015211247 the legalization fee of 846213 (eight hundred forty-six thousand two hundred thirteen) Armenian Drams calculated by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006.
must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.

This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Yerevan Municipality Staff.
Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan Municipality Staff.
