On legalizing an unauthorized structure

The decision of the Mayor of Yerevan concerns the legalization of an unauthorized residential structure with a total area of 100.8 square meters located on the land plot belonging to Suren Ashotovich Sogoyan at 59, 11th Street, Haghtanak district, Malatia-Sebastia administrative district. The decision stipulates that the preservation of the structure does not violate the rights of other persons and does not threaten the life and health of citizens, and also that it was not built in alienation or safety zones of engineering and transport facilities. The decision obliges the person who carried out the construction to pay the legalization fee and fees related to the state registration of property rights within 60 days.

ON LEGALIZING THE UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT OWNED BY CITIZEN SUREN ASHOTI SOGHOYAN BY RIGHT OF OWNERSHIP AT THE ADDRESS: YEREVAN, MALATIA-SEBASTIA, HAGHTANAK DISTRICT, 11TH STREET, BLDG. 59

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", by points 10 and 11 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, taking as a basis the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued by the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality on 18.08.2026 regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, taking into account the positive technical conclusion No. 432-26 issued by "HABSHIN NAKHAGITS" LLC on 20.04.2026, the certificate issued by "Global Partners Group" LLC on 17.02.2026 regarding the external dimensions of unauthorized constructions, as well as taking into account the applications of the person who carried out the construction (21.04.2026 No. D-40637-26, 27.05.2026 No. D-54408-26).

  1. To recognize as legal the unauthorized construction (residential buildings) with a total area of 100.8 square meters carried out on the land plot owned by citizen Suren Ashoti Sogoyan by right of ownership (state registration certificate of rights to real estate No. 14042026-01-0169, registration code No. 2026ZVPLDS in the Cadastre Committee of the Republic of Armenia) at the address: Yerevan, Malatia-Sebastia, Haghtanak district, 11th street, bldg. 59.

  2. To take note that:

  1. the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.

  2. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed in violation of urban planning norms and

significant violations of norms and does not give rise to the right to demand a compulsory servitude.
3. Establish that the person who carried out the construction:

  1. within a 60-day period from the date of adoption of this decision, shall pay the legalization fee of 274680 (two hundred seventy-four thousand six hundred eighty) Republic of Armenia drams, calculated by the Republic of Armenia Government Decision No. 912-N dated May 18, 2006, to the Yerevan city budget account N900015211247.
  2. shall pay the fees and duties related to the state registration of property rights of the structure at their own expense.
  3. in case of failure to make the payment established for legalization within a 60-day period from the date of adoption of this decision, this decision shall be considered void.
  1. This decision is subject to state registration in the manner prescribed by the RA legislation.
  2. This decision may be appealed through administrative procedure to the Mayor of Yerevan or through judicial procedure to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be placed on the Head of the Department of Architecture and Urban Development of the staff of the Yerevan Municipality.
  4. The supervision over the implementation of the decision shall be placed on the Secretary of the staff of the Yerevan Municipality.
