REGARDING THE LEGALIZATION OF AN UNAUTHORIZED STRUCTURE LOCATED ON A LAND PLOT BELONGING TO CITIZEN BRYAN ADRIAN ELLISON BY RIGHT OF OWNERSHIP AT THE ADDRESS YEREVAN, ARABKIR, SOSE STREET H.21/1

Guided by the Law "On Defining the Procedure for Cadastral Assessment Approximated to the Market Value of Real Estate for the Purpose of Real Estate Taxation", points 10 and 11 of the procedure approved by the Decision of the Government of the Republic of Armenia h.912-N dated May 18, 2006, based on the Decision of the Mayor of Yerevan h.5299-A dated November 12, 2010, the professional conclusion regarding the compliance of the structure with the legalization conditions established by part 5 of Article 188 of the Civil Code, issued by the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality on 15.07.2026, the positive technical conclusion issued by "HABSHIN NAKHAGITS" LLC on 08.05.2026, taking into account the certificate regarding the external dimensions of unauthorized structures issued by "KAFE" LLC on 09.05.2026, the letter h.GM/8409-2026 dated 30.04.2026 of the Deputy Head of the RA Cadastre Committee, as well as the applications of Bryan Adrian Ellison, represented by a representative (19.05.2026 h.D-51084-26, 13.07.2026 h.D-72886-26).

  1. To recognize as legal the unauthorized structure with a total area of 127.3 square meters (residential house /1st floor: 34.2 square meters, 2nd floor: 18.6 square meters, 3rd floor: 73.3 square meters/, fence: 1.2 square meters) located on the land plot belonging to citizen Bryan Adrian Ellison by right of ownership (certificate of state registration of rights to real estate h.09082022-01-0398 dated 09.08.2022) at the address Yerevan, Arabkir, Sose street h.21/1.

  2. To take note that:

  1. the preservation of the structure does not violate the rights and legally protected interests of other persons or does not pose a threat to the life and health of citizens;

  2. the building is not constructed in the alienation or safety zones of engineering-transportation objects, or is not constructed in violation of urban planning norms and

with significant violations of the rules and does not create the right to demand compulsory servitude.

  1. Establish that the owner of the land plot:

  1. within 60 days from the date of adoption of this decision, must pay to the account N900015211247 of the Yerevan city budget the legalization fee of 781749 (seven hundred eighty-one thousand seven hundred forty-nine) Armenian drams calculated by the decision H.912-N of May 18, 2006, of the Government of the Republic of Armenia.

  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.

  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.

  1. This decision is subject to state registration in the manner prescribed by the legislation of the Republic of Armenia.

  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.

  3. The organization and responsibility for the execution of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Staff of the Yerevan Municipality.

  4. The control over the execution of the decision shall be assigned to the Secretary of the Staff of the Yerevan Municipality.
