ON LEGALIZING AN UNAUTHORIZED CONSTRUCTION LOCATED ON THE LAND PLOT BELONGING TO CITIZEN ARMEN ISHKHANI TSATRYAN BY RIGHT OF OWNERSHIP AT YEREVAN, SHENGAVIT, NOR KHARBERD 8TH STREET H.68

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", by points 10 and 11 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, taking as a basis the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, the professional conclusion issued on 20.07.2026 by the Department of Architecture and Urban Development of the Yerevan City Hall Staff regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the positive technical conclusion issued on 20.03.2026 by "KOTI GROUP" LLC, taking into account the conclusion issued on 17.04.2026 by "HL GROUP" LLC regarding the external dimensions of unauthorized constructions, as well as the application of the person who carried out the construction (27.04.2026 No. D-42483-26).

  1. To recognize as legal the construction with a total area of 198.7 square meters (residential building: 178.5 square meters, covering: 18.0 square meters, fence: 2.2 square meters) carried out without authorization on the land plot belonging to citizen Armen Ishkhani Tsatryan by right of ownership (state registration of rights to real estate certificate No. 17082020-01-0094 issued on 17.08.2020, accounting code No. 2022Q3ZJFX in the Cadastre Committee of the Republic of Armenia) at Yerevan, Shengavit, Nor Kharberd 8th Street h.68.

  2. To take into consideration that:

    1. the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.
  1. the building is not constructed in the alienation or safety zones of engineering and transport facilities, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.
  1. Establish that the owner of the land plot:
  1. within 60 days from the date of adoption of this decision, must pay to the account N900015211247 of the Yerevan city budget the legalization fee of 391241 (three hundred ninety-one thousand two hundred forty-one) Republic of Armenia drams calculated by the decision N912-N of May 18, 2006, of the Government of the Republic of Armenia.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision is considered null and void.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Department of Architecture and Urban Development of the Yerevan City Hall Staff.
  4. Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan City Hall Staff.
