ON LEGALIZING THE UNAUTHORIZED CONSTRUCTION CARRIED OUT BY CITIZEN HAKOB
MKRTICH TUTUNJYAN IN THE LAND PLOT OWNED AT THE ADDRESS:
YEREVAN, NOR NORK, H. TEVOSYAN STREET, H.115/11

Guided by the law "On establishing the procedure for cadastral valuation approximated to the market value of real estate for the purpose of real estate tax assessment", by point 17 of the procedure approved by the decision of the Government of the Republic of Armenia No. 912-N of May 18, 2006, based on the decision of the Mayor of Yerevan No. 5299-A of November 12, 2010, regarding the compliance of the construction with the legalization conditions defined by part 5 of article 188 of the Civil Code, the professional conclusion issued by the Department of Architecture and Urban Development of the Yerevan Municipality Staff on 21.08.2026, taking into account the positive technical conclusion issued by "Seismexpert" LLC on 07.08.2026, the conclusion issued by "Avagyan Sofia" IE on 09.06.2026 regarding the external dimensions of unauthorized constructions, as well as the applications of the person who carried out the construction (21.11.2022 No. D-108669-22, 10.06.2026 No. D-59764-26, 11.08.2026 No. D-84588-26):

  1. To recognize as legal the unauthorized construction with a total area of 721.2 square meters (industrial / unfinished guardhouse) carried out by citizen Hakob Mkrtich Tutunjyan in the land plot owned at the address: Yerevan, Nor Nork, H. Tevosyan Street, h.115/11 (state registration certificate of rights to real estate No. 30112022-01-0033, code for entering registration data in the Cadastre Committee of the Republic of Armenia No. 2026RYFE3N).

  2. Take note that:

    1. the preservation of the construction does not violate the rights and legally protected interests of other persons or threaten the life and health of citizens.
    2. the building is not constructed in the alienation or safety zones of engineering and transport objects, or is not constructed with significant violations of urban planning norms and rules and does not give rise to the right to demand compulsory servitude.

  3. To establish that the owner of the land plot:

  1. within 60 days from the date of adoption of this decision, must pay to account N900015211247 of the Yerevan city budget the legalization fee of 3468251 (three million four hundred sixty-eight thousand two hundred fifty-one) Armenian drams calculated by the decision h.912-N of May 18, 2006, of the Government of the Republic of Armenia.
  2. must pay the fees and duties related to the state registration of property rights of the structure at his own expense.
  3. in case of non-payment of the fee established for legalization within 60 days from the date of adoption of this decision, this decision shall be considered null and void.
  4. the design permit (architectural and planning task) attached to this decision serves as a basis for the development of architectural and construction design documents for the purpose of completing the unfinished construction legalized by point 1 of this decision.
  1. This decision is subject to state registration in accordance with the procedure established by the legislation of the Republic of Armenia.
  2. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within two months from the date of its entry into force.
  3. To assign the organization and responsibility for the execution of this decision to the Head of the Department of Architecture and Urban Development of the Staff of the Yerevan Municipality.
  4. To assign the control over the execution of the decision to the Secretary of the Staff of the Yerevan Municipality.
