On the legalization of a self-built structure

This decision legalizes a self-built residential house located on a municipal land plot at Vardashen 11th Street, No. 5/5, with an area of 763.1 sqm. The land plot's designation is set to residential development. The builder, Mesrop Manuki Khachatryan, is offered to purchase the property through direct sale. The head of the Architecture and Urban Development Department is authorized to finalize the sale after payment confirmation. Control of the decision's execution is assigned to the Secretary of the Municipality Staff.

ON LEGALIZATION OF AN UNAUTHORIZED CONSTRUCTION

Considering that the preservation of the unauthorized construction located on the land plot owned by the city of Yerevan, at Vardashen 11th Street, H.5/5, does not violate the rights and legally protected interests of other persons, does not pose a threat to the life and health of citizens, taking into account that the unauthorized construction is not built on land plots provided for by Article 60 of the Land Code, in the alienation and safety zones of engineering and transport facilities and with significant violations of urban planning norms and rules, does not create the right to demand compulsory servitude, as well as based on the fact that the unauthorized construction is not located in the approved zones of urban planning complex programs of state or community significance, guided by the law "On establishing the procedure for cadastral valuation of real estate approximated to the market value of real estate for the purpose of taxation with real estate tax", parts 2 and 5 of Article 188 of the Civil Code, point 2 of the procedure approved by the Government of the Republic of Armenia's decision N731-N of May 18, 2006, point 33 of the procedure approved by the Government of the Republic of Armenia's decision N912-N of May 18, 2006, as well as taking into account the professional conclusion issued by the Architecture and Urban Planning Department of the Yerevan City Hall staff on 15.04.2026, the certificate N.AT-23072025-01-0821 from the Cadastre Committee of the Republic of Armenia regarding the absence of a match on 23/07/2025, the positive technical conclusion issued by "HABSHIN NAKHAGITS" LLC on 17.06.2025, the applications of the person who carried out the construction, represented by the representative (26.05.2022 N.D-25580-22, 13.07.2022 N.D-49490-22, 07.05.2024 N.D-59389-24, 11.10.2024 N.D-130043-24, 17.06.2025 N.D-64790-25, 10.10.2025 N.D-112139-25).

  1. The unauthorized construction with the functional purpose of a residential house (code N.2022OXSZCB for entering data into the Cadastre Committee of the Republic of Armenia) built on the land plot with a total area of 763.1 sq.m. located at Vardashen 11th Street, H.5/5, Yerevan, which is the property of the city of Yerevan, shall be considered the property of the city of Yerevan and recognized as legal (the plans of the land plot and buildings are attached).

  2. Based on the provisions of the general plan of Yerevan city approved by decision No. 204-N of the Yerevan City Council of the Republic of Armenia dated 10.09.2024, to define the functional purpose of the land plot with an area of 763.1 sq.m. mentioned in point 1 of this decision as residential development.

  3. To make an offer to the person who carried out the construction, Mesrop Manuki Khachatryan, hereinafter referred to as the Buyer, to acquire the legalized structure and land plot mentioned in point 1 of this decision by direct sale with the right of preferential purchase.

  4. To authorize the head of the Architecture and Urban Development Department of the Yerevan Municipality Staff, after receiving a written certificate-extract provided by the financial department of the staff confirming the payment of the amounts for the legalization of the structure mentioned in point 1 of this decision and the land plot allocated for it, in the amount and manner prescribed, by the person who carried out the unauthorized construction, and the fact that it has been credited to the corresponding account of the Yerevan community budget, to conclude a real estate purchase and sale agreement with the Buyer on behalf of the Mayor of Yerevan within a period of 30 days.

  5. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia, within a two-month period from the date of its entry into force.

  6. To assign the control over the execution of the decision to the Secretary of the Yerevan Municipality Staff.
