ON CLARIFYING THE BOUNDARIES AND ISSUING A PLAN FOR THE LAND OCCUPIED BY THE RESIDENTIAL BUILDING LOCATED AT 21 RUSTAVELI STREET

The basis for the adoption of the administrative act was Naira Yeremyan's application regarding the clarification of the boundaries and issuance of a plan for the land occupied by the residential building located at 21 Rustaveli Street.

The basis for discussing the issue was the state registration certificate of rights to real estate No. 21112012-01-1607 and the letter of the RA Cadastre Committee No. GM/9209-2026.

Upon studying the documents, it was found that the actual area of the land plot located at the aforementioned address, entirely burdened with a residential building, is 108.25 sq.m., instead of the 105.0 sq.m. recorded in the state registration certificate of rights to real estate No. 21112012-01-1607.

According to the general plan of the city of Yerevan approved by Decision No. 204-N of the Council of Elders of the City of Yerevan on September 10, 2024, the land plot under consideration is partially located in the mixed development zone of settlements of targeted designation.

The land plot under consideration is not included in the list of restrictions of Article 60 of the RA Land Code. According to the annexes approved by Decision No. 1023-N of the Government of the Republic of Armenia dated June 4, 2020, the land plot is located in zone 3 according to the agreed spatial assessment scheme. The code of the land plot is: 01-006-0508-0325.

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Procedure", point 2 of part 1 of Article 10, Article 135 of the Civil Code, Articles 52, 59 and point 8 of Article 64 of the Land Code, Decision No. 1023-N of the Government of the Republic of Armenia dated June 4, 2020, taking into account the conclusion N/32725-26 of the Department of Architecture and Urban Development of the Yerevan City Hall staff.

DECISION OF THE MAYOR OF YEREVAN

  1. To establish that the area of the land plot occupied by the residential house located at Rustaveli Street, building 21, owned by Naira Yeremyan by right of ownership, is 108.25 sq.m., the boundaries of which are determined by the plan approved in the prescribed manner.
  2. In accordance with the general plan of the city of Yerevan approved by decision No. 204-N of September 10, 2024, of the Council of Elders of the City of Yerevan, to establish the targeted designation (category) of the land plot occupied by the residential house located at Rustaveli Street, building 21, as settlements, and the functional designation (purpose of use) as residential development, in accordance with sub-point 3 of point 24 of the procedure approved by decision No. 1920-N of December 29, 2011, of the Government of the Republic of Armenia.
  3. To establish that, in accordance with point 1 of part 8 of article 64 of the Land Code, the land plot occupied by the residential house mentioned in point 1 of this decision is transferred to Naira Yeremyan by right of ownership by virtue of law.
  4. The right arising from this decision is subject to state registration in the relevant subdivision of the Cadastre Committee of the Republic of Armenia.
  5. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  6. To assign the organization and responsibility for the execution of the decision to the heads of the Architecture and Urban Development, and Real Estate Management Departments of the Yerevan City Hall staff.
  7. Control over the execution of this decision is ensured by the Secretary of the Yerevan City Hall staff.
