ON RESTORING THE RIGHTS OF VIKTORYA ALBERTI CHARCHYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT YEREVAN, KENTRON, KOND DISTRICT H.199

The application of Viktorya Alberti Charchyan (born 22.06.1959) served as the basis for discussing the issue. At Yerevan, Kentron, Kond district h.199, the total area of the land plot is actually 118.1 sq.m, of which the land plot with an area of 81.0 sq.m belongs to Viktorya Alberti Charchyan by right of ownership (state registration of rights to immovable property certificate dated 12.03.2007, h.14022023-01-0321).

Considering that the residential house was built before 2001, the letter of "National Archives of Armenia" SNCO dated 02.04.2026, h.H-2188, the conclusion of the Architecture and Urban Development Department of the Yerevan City Hall staff dated 15.07.2026, h.20-El-26650, according to which the land plot occupied by the house at Yerevan, Kentron, Kond district h.199 and necessary for its maintenance complies with the requirements defined by points 1, 2, 3 of part 2 of article 64 of the Land Code and is not included in the list of land plots provided for by article 60 of the same code, guided by article 2 of the law "On the status of individual residential houses for which title documents have not been preserved".

  1. Restore Viktorya Alberti Charchyan's right of ownership to the property units located at Yerevan, Kentron, Kond district h.199, to the extent of the land plot with an area of 37.1 sq.m adjacent to the legal land plot with an area of 81.0 sq.m occupied by the residential house and necessary for its maintenance, recognizing her right of ownership to the land plot with an area of 37.1 sq.m and the buildings located thereon.

  2. Based on the general plan of Yerevan approved by decision h.204-N of the Council of Elders of the City of Yerevan dated 10.09.2024, define the functional purpose of the land plot with a total area of 118.1 sq.m located at Yerevan, Kentron, Kond district h.199 as residential development.

  3. The boundaries of the land plot are determined by the plan approved by the Mayor of Yerevan.

  4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force. 5. The organization and responsibility for the execution of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan City Hall Staff. 6.
