This decision restores the land allocation grounds and property rights for a residential building and its adjacent land plot located at 17 M. Avetisyan 3rd Street, Kanaker-Zeytun administrative district, Yerevan, to Sona Ladiki Movsesyan and Anzhela Khachaturyan Margaryan. It also designates the functional purpose of the 332.87 sqm land plot as residential development, based on the main plan of Yerevan city. ON RESTORING THE GROUNDS FOR LAND ALLOCATION OF THE LAND PLOT OCCUPIED BY THE RESIDENTIAL HOUSE AT YEREVAN, KANAKER-ZEYTUN, M. AVETISYAN 3RD STREET H.17, AND RESTORING THE RIGHTS OF SONA LADIKI MOVSESYAN AND ANJELA KHACHATURI MARGARYAN TO THE LAND PLOT ADJACENT TO THE RESIDENTIAL HOUSE AND THE BUILDINGS

The application (10.12.2021թ. հ.Մ-17279) of Sona Ladiki Movsesyan (born 26.04.1962) and Anjela Khachaturi Margaryan (born 16.04.1988) served as the basis for discussing the issue. The area of the land plot at Yerevan, Kanaker-Zeytun administrative district, M. Avetisyan 3rd Street h.17 actually constitutes 332.87 sq.m., of which 85.68 sq.m. is the land plot occupied by legal structures, and 7.14 sq.m. is common joint property with the address M. Avetisyan 3rd Street h.17/1 (certificate of ownership 25.11.1991թ. հ.1487, according to the law of inheritance rights հ.6690 and հ.6692 certificates issued 23.08.2021թ.).

Considering that the residential house was built before 2001, the letters of the RA Cadastre Committee dated 16.01.2026թ. հ.ԱՏ-16012026-01-1180, "National Archives of Armenia" SNCO, the conclusion of the Architecture and Urban Development Department of the Yerevan Municipality Staff dated 21.04.2026թ. հ.20-Ել-Մ-17279, according to which the land plot occupied by the house at Yerevan, Kanaker-Zeytun administrative district, M. Avetisyan 3rd Street h.17 and necessary for its maintenance complies with the requirements defined by points 1, 2, 3 of part 2 of Article 64 of the Land Code and is not included in the list of land plots provided for by Article 60 of the same code, guided by point 1 of part 8 of Article 64 of the Land Code, Article 2 of the Law "On the Status of Individual Residential Houses with Undocumented Rights".

  1. Restore the grounds for land allocation of the land plot occupied by the residential house owned by Sona Ladiki Movsesyan and Anjela Khachaturi Margaryan at Yerevan, Kanaker-Zeytun administrative district, M. Avetisyan 3rd Street h.17, to the extent of a land plot of 85.68 sq.m., and the right of ownership to the land plot adjacent to the residential house to the extent of a land plot of 247.19 sq.m.

recognizing their right of ownership over a land plot with an area of 332.87 sq.m. and buildings located on a land plot with an area of 247.19 sq.m. 2. The boundaries of the land plot are determined by the plan approved by the Mayor of Yerevan. 3. Based on the General Plan of Yerevan approved by Decision No. 204-N of September 10, 2024, of the Yerevan City Council, the functional purpose of the 332.87 sq.m. land plot located at M. Avetisyan 3rd Street, No. 17, Kanaker-Zeytun administrative district, Yerevan, shall be defined as residential development. 4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force. 5. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan Municipality Staff. 6. Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan Municipality Staff.
