ON RESTORING THE RIGHTS OF NARINE HASRATHI ASATRYAN TO THE LAND PLOT AND BUILDINGS ADJACENT TO THE RESIDENTIAL HOUSE AT YEREVAN, AJAPNYAK, SILIKYAN DISTRICT, 7TH STREET, H.31, AND ALIENATING THE LAND PLOT WITH AN AREA OF 86.19 SQM THROUGH DIRECT SALE

The application of Narine Hasrathi Asatryan (born 09.09.1965) served as the basis for discussing the issue.

At the address Yerevan, Ajapnyak, Silikyan District, 7th Street, H.31, the total area of the land plot actually constitutes 1586.19 sqm, of which the land plot with an area of 1200.0 sqm belongs to Narine Hasrathi Asatryan by right of ownership (certificate of registration of ownership (use) right of immovable property dated 17.06.1992, №2650045).

Considering that the residential house was built before 2001, the letter of the Cadastre Committee of Immovable Property of the Republic of Armenia dated 24.05.2024, №AT-24052024-01-0944, the letter of the "National Archives of Armenia" SNCO dated 13.05.2026, №H-3948, the conclusion of the Architecture and Urban Development Department of the Staff of the Yerevan Municipality dated 20.03.2026, №20-El-86466, according to which the land plot occupied by the residential house at Yerevan, Ajapnyak, Silikyan District, 7th Street, H.31, and necessary for its maintenance, complies with the requirements set forth in points 1, 2, 3 of part 2 of Article 64 of the Land Code of the Republic of Armenia and is not included in the list of land plots provided for in Article 60 of the same code, guided by Article 2 of the RA Law "On the Status of Individual Residential Houses for which Title Documents have not been Preserved", the decision of the Government of the Republic of Armenia dated November 13, 2008, №1328-N, Article 3 of the Law "On Establishing the Procedure for Cadastral Valuation Approximated to the Market Value of Immovable Property for the Purpose of Immovable Property Tax Assessment".

  1. Restore Narine Hasrathi Asatryan's right of ownership to the property units located at Yerevan, Ajapnyak, Silikyan District, 7th Street, H.31, to the extent of a land plot with an area of 300.0 sqm adjacent to the legal land plot with an area of 1200.0 sqm occupied by the residential house and necessary for its maintenance, recognizing their right of ownership to the land plot with an area of 300.0 sqm and the buildings located on the land plot with an area of 386.19 sqm.

  2. Alienate the land plot with an area of 86.19 sqm, which is used in excess of the 300.0 sqm land plot mentioned in point 1 of this decision, to Narine Hasrathi Asatryan through direct sale at the cadastral value of the 9th zone of area valuation.

  3. Authorize the Head of the Architecture and Urban Development Department of the Yerevan Municipality Staff to conclude a land sale and purchase agreement with Narine Hasrat Asatryan on behalf of the Mayor of Yerevan.

  4. Based on the General Plan of Yerevan approved by decision No. 204-N of September 10, 2024, of the Yerevan City Council, define the functional purpose of the 1586.19 sq.m. land plot located at 31, 7th Street, Silikyan District, Ajapnyak, Yerevan, as residential development.

  5. The boundaries of the land plot are determined by the plan approved by the Mayor of Yerevan.

  6. Take into account that:

  1. in accordance with paragraph 4 of Article 299 of the Civil Code, the requirement for notarization does not apply to a land sale and purchase agreement if all its terms are set forth in accordance with the terms of the model agreement approved by Decision No. 1851-N of December 22, 2011, of the Government of the Republic of Armenia, does not contain other terms, and the authenticity of the parties' signatures in that agreement has been recognized in the manner prescribed by the law on state registration of rights to property;
  2. the land sale and purchase agreement is subject to notarization if its terms are not set forth in accordance with the terms of the model agreement approved by Decision No. 1851-N of December 22, 2011, of the Government of the Republic of Armenia, and the rights arising from it, in accordance with Article 24 of the Law of the Republic of Armenia "On State Registration of Rights to Property," must be submitted for state registration no later than 30 working days from the date of notarization of the said agreement.
  1. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.
  2. The organization and responsibility for the implementation of this decision shall be assigned to the Head of the Architecture and Urban Development Department of the Yerevan Municipality Staff.
  3. Control over the implementation of the decision shall be assigned to the Secretary of the Yerevan Municipality Staff.
