On alienating the land adjacent to Shirazi street 47/1 by direct sale and providing an address

By this decision, the Mayor of Yerevan permits the direct sale of a 17.10 sqm land plot adjacent to 47/1 Shirazi Street to Gor Tovmasyan and Eduard Hovhannisyan as an expansion, for construction purposes. The land plot is assigned a new address: H. Shirazi Street, No. 47/4. The decision also defines the targeted and functional designations of the land plot, and authorizes the relevant department of the City Hall to carry out the works for state registration and concluding the sale and purchase agreement.

ON ALIENATION OF THE LAND ADJACENT TO SHIRAZ STREET H.47/1 ADDRESS THROUGH DIRECT SALE AND GRANTING AN ADDRESS

The basis for the adoption of the administrative act was the application of Gor Tovmasyan and Eduard Hovhannisyan's authorized representative Elen Nersesyan, regarding the provision of the land adjacent to the land owned by Gor Tovmasyan and Eduard Hovhannisyan by right of common shared ownership at Shiraz Street h.47/1 address (state registration certificate of rights to immovable property no. 21062024-01-0287) as an expansion, for construction purposes, through direct sale.

The basis for the discussion of the issue was the state registration certificate of rights to immovable property no. 21062024-01-0287.

According to the submitted topographic survey, the actual area of the land plot under consideration for additional provision for expansion purposes is 17.10 sq.m., the outline size and position of which do not allow it to become a separate subject of public bidding, and in accordance with the requirements of sub-point 2 of point 1 of the RA Government Decision no. 550-N of May 26, 2016, namely: the alienated land plot is adjacent to the expanding land plot, and depending on the location, relief or dimensions of the alienated land plot, in accordance with urban planning norms, it can be used exclusively for the purpose of servicing the building or structure located on the expanding land plot or for their reconstruction, strengthening, restoration, modernization and improvement works.

The land plot under consideration is not included in the land plot defined by Article 60 of the Land Code and is located in the 7th zone of the agreed scheme for land valuation of Yerevan city (the land plot code is 01-001-0554-0070, Decision no. 424-N of the Council of Elders of Yerevan city dated 11.04.2012 (line: 1559)).

According to the General Plan of Yerevan city approved by Decision no. 204-N of the Council of Elders of Yerevan city dated September 10, 2024, the land plot under consideration is located in the zone of other lands of settlement purpose.

Guided by Article 49 of the Law "On Local Self-Government in the City of Yerevan", Articles 3, 53, 59 and 60 of the Law "On the Fundamentals of Administration and Administrative Procedure", the "Procedure for Cadastral Valuation Approximated to the Market Value of Immovable Property for the Purpose of Immovable Property Taxation"

According to the Law "On Participatory Land Management", by Resolution No. 1023-N of the Government of the Republic of Armenia dated June 4, 2020, by Articles 7, paragraphs 4 and 5, and Article 66, paragraph 1, point 8, and Article 59 of the Land Code, by Sub-point 2 of Point 1 of Resolution No. 550-N of the Government of the Republic of Armenia dated May 26, 2016, by Resolution No. 2387-N of the Government of the Republic of Armenia dated December 29, 2005, by the Appendix to Resolution No. 463-N of the Council of Elders of the City of Yerevan dated December 23, 2025, taking into account Conclusion No. D-53126-26 of the Department of Architecture and Urban Development of the Yerevan City Hall Staff:

  1. To establish that the area of the land plot adjacent to Shirazi Street No. 47/1, which is communal property, is 17.10 sq.m.

  2. The boundaries of the land plot are determined by the plan approved in the established procedure.

  3. According to the General Plan of the City of Yerevan approved by Resolution No. 204-N of the Council of Elders of the City of Yerevan dated September 10, 2024, to define the target designation (category) of the land plot with an area of 17.10 sq.m. adjacent to Shirazi Street No. 47/1 as settlements, and the functional designation (purpose of use) as public development, in accordance with Sub-point 3 of Point 24 of the procedure approved by Resolution No. 1920-N of the Government of the Republic of Armenia dated December 29, 2011.

  4. To assign the address "H. Shirazi Street, No. 47/4" to the land plot with an area of 17.10 sq.m. adjacent to Shirazi Street No. 47/1.

  5. The land plot with an area of 17.10 sq.m. adjacent to the land plot located at Shirazi Street No. 47/1, owned by Gor Tovmasyan and Eduard Hovhannisyan by right of common shared ownership, after registration in the name of the Yerevan community, as an expansion, for development purposes, to alienate (sell) by direct sale by right of ownership to Gor Tovmasyan and Eduard Hovhannisyan at a cadastral value approximated to the market value of the 7th zone of area valuation effective at the time of the decision, which amounts to 425,600 (four hundred twenty-five thousand six hundred) AMD and transfer to account No. 900015211320 of the Yerevan City Hall (income from land alienation).

  6. To authorize the Head of the Real Estate Management Department of the Yerevan City Hall Staff to:

    1. ensure the state registration work in the name of the Yerevan community for the land plot mentioned in Point 1 of this decision.
    2. within five working days after the state registration of the right in the name of the Yerevan community and the submission of an application by Gor Tovmasyan and Eduard Hovhannisyan regarding the conclusion of a sale and purchase agreement with the Yerevan City Hall and documents confirming the payment of the cadastral value approximated to the market value of the land plot and the local fee, to conclude a sale and purchase agreement for the land plot on behalf of the Mayor of Yerevan.

  7. To instruct the Head of the Real Estate Management Department of the Yerevan City Hall Staff to send information regarding the address of the real estate provided on the basis of the decision to the Cadastre Committee of the Republic of Armenia and the relevant department of the Yerevan City Police of the Republic of Armenia, the Head of the Ajapnyak administrative district, within 3 working days.

  8. Establish that if the cadastral values approximated to the market value of the land plots are not paid by the acquirer of the land plots within a 15-day period from the moment of adoption of this decision, then point 5 and sub-point 2 of point 6 of the decision shall be considered null and void.

  9. Take note that all expenses for state registration of property rights arising from this decision, approval of the land plot plan, provision of an address, notarization of the contract, as well as obtaining a unified certificate provided by law, and other necessary payments are carried out at the expense of Gor Tovmasyan and Eduard Hovhannisyan.

  10. Take note that the sale and purchase agreement is subject to notarization, and the right arising from the agreement is subject to state registration in the Cadastre Committee, in accordance with the attached design permit /architectural and planning assignment/.

  11. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the Administrative Court of the Republic of Armenia within a two-month period from the date of its entry into force.

  12. Organize the execution of the decision and assign responsibility to the heads of the Architecture and Urban Development, and Real Estate Management Departments of the Yerevan City Hall Staff.

  13. Control over the implementation of this decision is ensured by the Secretary of the Yerevan City Hall Staff.
