По адресу Комитаса 38 торговый киоск установлен вплотную к остановке Проспект Комитаса / Улица Риги, в границах посадочной зоны. Свободный проход между киоском и краем проезжей части отсутствует. Использование торгового киоска (совершение покупки, осмотр товара) вынуждает выходить на проезжую часть, что может вынуждать нарушать ПДД или способствовать этому. Кроме того, открытые створки киоска отнимают общественное пространство (тротуар) и отрезают один из возможных проходов к остановке для жителей. Согласно ՀՀՇՆ 30-01-2023 (приказ № 04-Ն от 22.05.2023) при определении ширины ходовой части тротуара площадки под киоски не учитываются, то есть нормативная ширина (Таблица 29) должна оставаться свободной от киоска. Ст. 25 ч. 12 Закона РА «Об обеспечении безопасности дорожного движения» разрешает ожидать транспорт только на посадочной площадке или тротуаре — здесь это может быть ограничено. Прошу выехать на место, замерить свободную ширину прохода, проверить наличие разрешения на размещение (Постановление Правительства РА № 896 от 24.09.2001) и согласия Полиции по ст. 32 ч. 1 п. «а» указанного закона, и при нарушении обязать перенести киоск за пределы посадочной зоны.Komitas avenue 38, Arabkir, Yerevan

Pursuant to the RA Law "On Urban Development Control", we request: To conduct a control survey of the boundaries of land plot 01-003-0112-0191 and the area actually occupied by the kiosk, including open flaps, display cases, and supports. To record by survey the remaining width of the used part of the sidewalk when the kiosk is in operation, to ascertain compliance with Table 29 of RA Urban Development Norms 30-01-2023 and the norms of RA Urban Development Norms 31-01.01-2023. To issue an enforceable order for the dismantling of external display cases/supports from communal land and for bringing the object's activities strictly within the allocated 5.1 sq. m. boundaries. To initiate proceedings under Article 48 and Article 154 of the RA Code of Administrative Offenses and to inform the applicant of the measures taken within the period prescribed by law.
